I suppose you could argue that in every speed-measuring device used by police in Ontario, and supported by case law such as R. v. Vancrey, R. v. Schlesinger, etc., the device had to be tested and shown to be working correctly both before and after the stop. Agree with Stanton. The way I see it, it looks like the officer was actually being lenient by charging her with "failure to report." It could've been worse. I suppose you could ask for a reduced fine in court, or possibly try to plea-bargain to a lesser charge. Technically, a report was made, but it was a false one. See what X-Copper says.

That would also be illegal: Failing to keep right except to pass (which is true in almost every US state as well). Doesn't matter if he's at the limit; if he's not passing, he's not allowed to be in that lane.

The only way for the points to be removed is for a conviction for 15 over (or less). The courts do not have control over demerit points. At 29 over, you'd get 3 points. Usually the police would seize the detector and give you the $170 fine. (I believe they're supposed to seize the detector, but that won't get you out of trouble here.)

If you pay the fine, because Illinois does not have full ticket and licencing reciprocity with Ontario, the matter simply "disappears" and the Illinois DMV would never hear about ...

If you plea bargain they might lower the speed to 29 over, or they might even drop it to 15 over if you also plead guilty to the validation sticker offence. All depends on the Prosecutor.

FYI. As hwybear says, the officer does not have to show you the radar reading.

Quebec applies demerit points based on its system, not Ontario's. So if you get convicted of a 32 over in Ontario, you would still get 3 points on your Quebec licence. Likewise, an Ontario driver convicted of 32 over in Quebec would get 4 demerit points applied to his/her Ontario licence.

Provide the proof to the officer and see what recommendations he makes to the Prosecutor. 11 months is generally not enough for an 11B, though. Usually you have to cross the 12-month line from the day of the offence. In your case, though, the delay was charged to the Crown for failure to provide disclosure (assuming your requests were proper).

In this instance, the vehicle's owner (if the offence got reported) would be looking at a $490 fine, no demerit points, no insurance increase, nothing on the driver abstract - just the fine.

I'm pretty sure it's 3 metres either side of the hydrant on the roadway. The fire truck has to be able to park as close to the hydrant as possible, so having a car there would obstruct the firefighters. I could be wrong about how the by-law is worded, but like I said, I think the ticket is correct based on the description given.
