Re: Are cops encouraged to park on private property ?

Police may use private property if conducting traffic surveillance, but the property owner does have the right to ask them to leave.

In some cases, people may avoid the business. In other cases, the business and/or residents have asked police to set up there because they have complained about people driving too fast, etc.

Yep I'd hire a paralegal. Some insurance companies will cancel your policy if you get a Careless Driving conviction.

Re: Unsafe lane change and destroyed evidence

The fact that you were unfamiliar with the area won't hurt you in court. Unfortunately, it won't help much, either. HOWEVER, things that could help you are what the one paralegal mentioned:

- Did the vehicle coming up behind you suddenly change lanes into the lane you wanted to merge into? (Didn't sound like he did from your answer, but it's a ...

Re: New Speed Trap Regulations

As the others have said, no new regulations came into effect in Ontario. It's probably one of those internet rumours... the first clue was that "it applied to all traffic enforcement, not just localized." You can get the latest version of the Ontario Highway Traffic Act here:

Re: police clocked me at 153km/h but put 156km/h cause of ra

Well if the officer says words to the effect of "I put 156 because of radar tolerance," a good paralegal or traffic lawyer would demolish him during cross-examination. For a serious charge like stunt driving, I'd recommend getting professional help.

Re: Error on ticket

No fine at all?!

I'd say you probably could get out of it, although the procedure may be a bit complex... Put the paperwork together (file the ticket, choose option 3 for a trial, etc). Basically it is a "default and appeal" process that's recognized by the courts in Ontario. What will happen is that you will get a trial date. If there's no fine ...

Re: G2 BAC above zero

Actually the law got tougher in August 2010... not much help there.

You can't get this "removed" from your record, but for this offence after three years (I think) it drops off your driver abstract. (Could be wrong though, might be a longer period.) Demerit points stay for two years, and almost all HTA convictions for three years. You can try ...

Re: TICKET FOR LED LIGHTS

Your son was charged under the section of the HTA that requires the front lights to be white or amber only, unfortunately. Even though there were other front lights, basically they require that any light facing the front can only be white or amber (except for authorized vehicles). If they were quite clearly blue in colour, then the charge is going ...

Re: When do the police call off a chase?

Around 3:00 a.m this morning I came off the 404 south onto the 401 west collector lanes. I moved over to the centre lane and had my window open a bit because I was having a cigarette. All of a sudden two lanes over to my left, what appeared to be a Porsche, passed me doing at least 250 k/mh.

I'm a bit late replying to this thread, but I do ...

Re: Rear ended car, Careless Driving charge

Respectfully, your parents are not choosing a wise course of action.

Now, the most likely outcome in your case would be a big fine and 6 demerit points... which would lead to a HUGE insurance increase (double), or your coverage would be terminated. Do they understand that? It is unlikely anything else would occur, given your situation. However ...

Re: mis-read sign

Since you said you've never had anything to do with the police before... you'd obviously have a clean driving record.

You've got the First Attendance meeting, so there are several options here. When you go to the First Attendance, they'll probably offer you a lower speed. In your case, I'd say it would either be 29 km/h over (which is 3 demerit ...

Unfortunately, Stanton is right. This forum cannot deal with criminal matters. Please contact a lawyer or a paralegal who specializes in dealing with impaired driving.

Re: A $6500 2 year old offence

What you'll need to do is go to the courthouse to re-open the case. You'll need to explain why you did not appear. Then, when you get a new trial date, you should do what Stanton says and that should take care of the "drive without insurance" part of it.

Re: fail to stop at a red light

Your husband should probably take some notes about what he recalls, including the conditions, the speed, his experience in driving the fuel truck, his noting the amber light, etc. There are also some good cases that you can read up on that may apply to your situation, such as the R. v. Sandhu case. In Sandhu, the defendant was charged with running ...
