Not arguing with you, racer, I was disappointed that the Crown wasn't pursuing more significant charges based on the witness statement.

I was hoping the guy would get assault or dangerous driving. That is nuts. Sounds like he deliberately hit the horse and rider. Obviously he's completely off his rocker.

But since he wasn't going more than 50 kilometres an hour over the posted speed limit, he'll just get a pat on the wrist.

If the sign has only English writing on it, then I believe that in this case, yes, you could argue it is an invalid sign. And I know the area you're talking about (not the sign specifically), but EVERYONE goes straight through in the turning lane. The only caveat about the bilingual defence is that for the sign to be invalid when it is English-only ...

However, at the same point in time I would appriciate not being given "the speech" when I am pulled over.

I've been lucky enough to not get "the speech" most of the time when I get stopped, but the two occasions where I did, I just smiled, nodded and bit my tongue, like I'm sure you have.

I mean just what exactly do you have to be doing to ***NOT*** see a horse and not be able to stop?

How can you be afforded defence of due dilligence if your vehicle has been impounded and your licence suspended... in other words, penalty handed out before you have an opportunity to provide any defence to strict liability?

What's a marked or an unmarked vehicle?

Marked vehicle has the full light package and the painting with "OPP" or whatever the police service is. Unmarked is not painted with police lettering/decals and the lights are embedded so you can't, at first glance, tell it's a police car (unless you really know what you're looking for).
