Are you currently in Ontario? If so, you have consented to being governed by the Highway Traffic Act, among other laws. If you don't want to be subject to the HTA, you can withdraw your "consent" by leaving the province.

Can you please explain where you got the idea that an act is not a law?

If somebody can correct me, please do, but I don't think any (?) US jurisdiction allows its police to conduct random "spot checks" of drivers simply because they are on that road at that time.

in my opinion, I don't mind the judge or the prosecutor want to do a similar assessment but the key point is this assessment must be done before the trial starts and the decision shall be given to me in advance.

Trying to flee an accident scene where a police officer was involved is even more stupid.

It's amazing. I don't know if it's some kind of basic instinct overriding common sense but a lot of people, when they get in to a collision, they take off like a bat out of hell.

Oh yeah - that police cruiser was one of three in as many days in the GTA ...

So the answer is you cannot be charged with failing to signal if no other vehicles are in the area that could be effected by my lack of signals.

Well to be technically accurate, you can be charged with it, but a conviction is a different matter. Think you're looking for section 142 (1) of the Highway Traffic Act:

Dang - like the others were saying, nice job in avoiding the crash. A lot of drivers would've just smashed the brakes, which, in that case, wouldn't have been enough!

As a female, this concerns me. I would not stop for an unmarked (as in Jeep, for instance) plainclothed *individual* attempting to pull me over. I would use a cellphone to call 911 or go to the nearest populated area or police station for my own safety. Well, bit of a technical explanation here. They can't amend the charge once the trial starts. They can, however, make a motion to withdraw the "reduced" ticket and replace it with the actual speed. :shock: An explanation of why they can't just do it during the trial or have the Justice convict you of something greater is one of those common-law ...

Well he might not show up for trial, but the info I have on the York Regional Police is that they tend to show up about 60% of the time or so. A plea-bargain could save you some dough, and I think you have some room to bargain here. Even if you get convicted, the insecure load doesn't net demerit points.
