...So last night I found out that according to the MTO the road is actually deamed a "Private Road With Public Access" and not a high way. So this being said I got into an accident on private property meaning no one should be at fault right?
No. The insurance company will still assign fault based on the circumstances involved and the fault ...

My question for her on the stand will be " yes or no, did I present you with a valid insurance card bearing the policy # for the vehicle I was driving?" The answer to that is unequivocally yes. I can't wait to see how it turns out. Do you want me to let you know?

Not to sound like a jerk but as the operator of a motor vehicle you have certain obligations...making sure the vehicle is mechanically sound and that certain documentation is kept with the vehicle while it is in operation is required by various provincial acts. These are not new requirements.

Re: Expired License + Small Collision
This could be a problem for you as it is a violation of your insurance policy, which requires you to be properly licenced and to be operating your vehicle legally. The insurance company has the option to decline to cover you if you were operating the vehicle illegally (ie while unlicenced).

1. Your rental is going to be contingent on your coverage (liability only? Loss of use coverage?) and whether or not your insurance company counts you as "at fault" (likely in this case).
2. Probably.
3. There is no harm in scheduling an early resolution meeting and requesting disclosure. The process is described on these forums repeatedly.

You won't lose your job over this. The Solgens office has a list of specific convictions that would prevent licencing/relicencing of Security Guards and the list (last I saw) was limited to Criminal Code and CDSA convictions, you may not be eligible to drive for your employer as their insurance company won't like the ticket, but you'd still be ...

You rear ended another vehicle, as much as you want it to be his fault it is your responsibility to leave sufficient room to react. It appears clear you failed to do this. Had you left more room you would have been able to stop in time and there would have been no accident.

My question is what is the possibility of having this dropped. The Crown will have a hard time proving I was careless, considering I was driving with precious cargo, I was more cautious then normally.
Pretty easy to prove, you crashed into the car in front of you. Had you been driving "carefully" you would have had adequate distance in front of ...

The picture shows conclusively how far your car was from the hydrant when the picture was taken, not how far it was from the hydrant when the ticket was issued. An unscrupulous person might simply move their car forward a meter or so, and then take a picture to support their defence.
The picture is no "smoking gun".

I believe that's only applicable when the cars are still in motion. Any vehicle that is stopped when struck should not be considered at fault.
True. Fault Determination rule 9(3) covers when the vehicles are in motion, and 9(4) when all are stopped except for the rearmost vehicle (page 5 of the document below);

You have the option of requesting early resolution or a trial, I'd suggest early resolution which would give you the chance to make a deal with the prosecutor for a reduction of some sort - if you don't like what they're offering you can still take it to trial, and then keep your fingers crossed that the officer doesn't show up (I wouldn't bank on ...

Pretty sure the $60 break he is talking about relates to the fact that you were ticketed for 30km over and not 37km over the posted limit. This isn't indicative of any confusion.

There are no demerit points for a red light camera ticket or photo radar ticket - they are processed in the same manner as parking tickets - against the registered owner of the vehicle regardless of who was operating the vehicle.

Typically in exchange for a guilty plea the fine can be reduced and the time to pay it can be extended. Not sure how much of a reduction you would be looking at, but friends who have taken this option say their fine was reduced by $100 or so.

Ohh you know... like anywhere reasonable... They often carry ziplock bags and put it under the wiper. In all honestly.. they could write the ticket and toss it into the wind, wouldn't matter you'd be fined with it when you went to renew the plates anyways!!
Ok, so aside from under the wipers where else would YOU consider reasonable?

So to clarify, do you have the "certificate of offence" and the "offence notice" or not? They are individually marked at the top of each ticket.

There are a few different copies of these tickets, you have to be more clear as to which copy the officer gave you.vince2000 wrote:So I got a ticket for this. It doesn't say any demerit points on it does that mean anything? And the officer gave me his and my version of the ticket. Does that mean anything or give me the chance to get off my ticket.

This is solid advice. The risk is NOT worth 4 hours pay. If you get into an accident while driving on a suspended licence it may invalidate the insurance coverage (even if you're not at fault) in an accident, and your employer would certainly find out if you got pulled for any reason and your suspension discovered ...
