Re: Goat show on the QEW

Radar,

I live in Hamilton and the rain from Friday, Saturday and Sunday caused major flooding in north-east Hamilton - and it did affect the QEW at Red Hill. Residents' basements were flooded with sewage water and a motorist was rescued from an underpass on Kenilworth near Burlington Street. The underpass has been known to flash flood - and ...

Re: Almost in an Accident

Well, my trailing at a distance behind other cars paid off today. I was rear-ended on the QEW this am. No damage sustained to my vehicle, but the guy who rear-ended me has a crinkled up hood. No charges laid on the other driver, from what I understand. Obviously, no charges with me, either. There was no sudden stop, as the traffic was stop and go ...

Re: Don't text and drive

Yes, my number 1 pet peeve. I was listening to 680am this morning and the average driving-and-texter is 23% more likely to get into an accident than a drive-and-talker or DUI-er. I think the last part (DUI-er) is a bit of a stretch.

However, they also said that a texter takes their eyes off the road for an average of 5 seconds per text. Enough ...

Re: Almost in an Accident

Nice manoeuvring. I've had to breach shoulders and islands on two separate occasions while stopped at lights (once) and on the highway (once). I am religiously devoted to giving myself a car length between my nose and the rear end of the car ahead of me because of these experiences. It's VERY scary to see a car coming at you at 60km, or breaks ...

Re: plaincloths officer stopped me for not checking

I didn't know about putting the hazards on, I know my plate very well, in phonetic code as well. I'd better after all these years with it.

Once again, thanks everyone.

Re: plaincloths officer stopped me for not checking

As a female, this concerns me. I would not stop for an unmarked (as in Jeep, for instance) plainclothed *individual* attempting to pull me over. I would use a cellphone to call 911 or go to the nearest populated area or police station for my own safety. If I cannot readily identify that the person attempting to pull me over is a police officer, I ...

Re: Police Abuse Highway 401

That sounds like a nightmare. It's pretty common knowledge not to get out of the car, but I would've waved my hands and tried to get her attention before exiting the car. My cousin works for OPP and the riskiest is often what we would think as routine traffic stops. Once, on the QEW, he pulled over some guy who then tried to run over him.

13 ...

"Problem" Prosecutor

I'm curious about this situation because I have a former instructor who, I've come to find out from relatives who are retired officers from various forces in Ontario and from old highschool classmates now in the industry as paralegals, is obnoxiously rude, disrespectful, and at times unprofessional to those pleading their tickets, including their ...

Re: Using Centre Lane Improperly

I did some further digging and found that the French Language defense likely won't work for me because the City of Hamilton is only included in the 25 regions that must comply with the French Language Act as it existed on December 31, 2000 .

Waterdown did not amalgamate to become part of the City of Hamilton until January, 2001 and was previously ...

Re: "improper use of headlights"

That was a great read.

I really like this place and I think I'm going to stick around. I've learned a lot, not just about my own ticket issue, in the past few days I've been here.

Re: Using Centre Lane Improperly

Hi Bookm,

I agree, but where the confusion comes in is in the subsection cited. Can they argue that according to the section I was charged under, I commited no offense, but that the appropriate subsection is actually 154 (1)(c) and then change it? This is why I have no intention of letting the prosecutor know beforehand of this and will only ...

Re: Using Centre Lane Improperly

Thanks RI!

I am not comfortable in court proceedings, though. As a paralegal, most of my work is in drafting and researching in RE law. I've been to court and I know the law through education, but I've yet to argue a case in a Provincial Offenses court. That's why I wanted to hear from others regarding the validity of my argument. Of course the ...

Re: Using Centre Lane Improperly

I need opinions, plz!

This is what I'm thinking on this. I go to trial and as a defense tell the justice that I did not commit an offense because the subsection 154(1)(b) cited specifically allows what I did, which was to prepare for a left turn, abort it, and merge again with traffic. When the The officer/prosecutor alleges that I used the middle ...

Re: Using Centre Lane Improperly

Yes, I think (c) is the correct one as well considering what the officer said he thought I did. So I will argue that I committed no violation based on the law cited on the Certificate of Offense, but they can give the officer an opportunity to change the charge within six months, can't they? It seems quite unjust that they allow this, but it may be ...

Re: Using Centre Lane Improperly

Hi Lawman,

Thank you VERY much for your response. So I am NOT reading it wrong, then. Phiew :? . I even read it upside down to give it another perspective, lol.

Can you explain briefly what the French Language Service Act defense is? If I can stretch my memory back to school, is it when the ticket must be in both official languages to be "on it's ...
