Re-opening a ticket is easy and usually granted. At a trial however if you need to fight the ticket, Your in person testimony and a witness won't necessarily trump the officers testimony.
I'd be very reluctant to say that any trial is a slam dunk for defines or the prosecutor. You forget that the human factor involved is the JP.

Re: Cop Never Filed Ticket in System
And there is no 5 year probation!
Three day suspensions and others issued at roadside are usually directly entered into the MTO system by the police records personnel.
If that wasn't done, the suspension is still valid, yet Mto isn't able to track it and apply the reinstatement fee because they have no record exists in their system that your ...

Re: Cop Never Filed Ticket in System
That's not a ticket. That was the suspension notice. There is no fine associated to a three day suspension for a warning on a roadside for a full G driver over the age of 21.
The $180 is the licence reinstatement fee to get a licence back after a suspension is served.

Re: Cop Never Filed Ticket in System
First of all, what type of licence do you have? A G or a G2 and how old were you at the time?
For a full G licenced driver who is over the age of 21, there is no "ticket" issued. Just the three day suspension for the warning.

I've never seen a manual listed on the Decatur website. Could you provide us with the link where you found it?
There are quite a few copies of manuals online and I've yet to see a copy of the Canadian manual.
jsherk is correct, tuning forks have no been used for quite some time. The standard for testing is simply to follow the manufacturers ...

Re: Plead or Request court date? (Worthwhile?)
There aren't any alternate charges to a handheld device ticket. The best you can expect would be a reduced fine. The points are applied by the MTO after a conviction is registered. They can't be reduced by the courts at all.
Unless you're a horrible driver and already have quite a few points on your licence, they shouldn't be of concern. Insurance ...

Re: Stunt driving charge at officers discretion ???
If you read section 172(5):
(5) Where a police officer believes on reasonable and probable grounds that a person is driving, or has driven, a motor vehicle on a highway in contravention of subsection (1), the officer shall,
(a) request that the person surrender his or her drivers licence; and

Re: car park "dings"
Police involvement would simply boil down to if there was any "intent". If not, then police involvement would end and the damaged person would only have civil court to compensate them. It's not a swift process either.

Re: LEO's vs job bloggs
Most of the powers of arrest and the power to enforce certain Acts are listed in act themselves. Criminal powers of arrest for both a Peace officer and citizen are in the Criminal Code. You might want to start there to answer your own questions.

Re: Speed Limit Sign Posting?
And depending on the area where the speed limit is, it's possible that the speed doesn't even need to be posted at all. ie 50 kilometres per hour on a highway within a local municipality or within a built-up area; and
80 kilometres per hour on a highway, not within a built-up area, that is within a local municipality.

Re: need to remove helmet?
A couple of points: 1- If the officer is satisfied that the driver and the photograph are the same person, there's no need to remove the helmet, but it's polite to do so.
2- The officer can actually order you to remove it because they can inspect it by law.
3- It would be pretty silly to offer a drivers licence to the officer that doesn't have your ...

Re: Passing on the right on a one lane street!
I'd actually consider charging both drivers. The green car for a Pass on right-not in safety. HTA 150(1) The yellow car for Turn-not in safety. HTA 142(1)
I won't regurgitate the sections. I figure most of you can navigate the HTA.
