I've been reading a lot of articles and websites and the above site seems to represent the common public opinion. It's quite clear that the vast majority of opinionated people are against this law. I think it's unwise for Mr. Fantino to challenge public ...

Re: Correction for posting, is this law 6 years old
Are you saying there wasn't even an emergency or reason to be on the shoulder other than to enforce this law?
If that's the case, it's an example of the police CAUSING an unnecessarily dangerous situation for hundreds of motorists. I'm sure it will be publicized as an educational exercise though.

OPP Const. Dave Woodford says what happens in court is not his concern. "My concern is getting those people off the road."
Statements like this should really concern the general population. Whether you have kids, employees, spouses, etc. you will probably be (or know someone who is) affected one day by some gung-ho cop, like this one, who seems ...

Re: Left turn through amber -Red light fail to stop HTA 144(18)
Just before court opens, the Crown will usually have everyone line up and ask what their intentions are (one at a time). If you can see that the officer is there, you could suggest that you would like to plea bargain based on the fact that your actions affected no other motorists or pedestrians, and you were pretty sure you entered safely on a ...

In no way do I mean to challenge what you say... I'm just confused because it seems to clash with the wording in the Provincial Offences Act.
If I understand the Act correctly, you have 30 days to lay a charge by way of a Part I certificate (usually a ticket at the side of the road).

Re: Errors and Omissions
So the Crown refused to drop the charge (they rarely do). Now you have to go to trial and fight for dismissal on the grounds that the information on the face of the ticket has deprived you of some right. The crown must prove the correct date and place of the offense (within reason). The date will likely be correct on the officers notes, but it's ...

We should also ban those obnoxious train horns at rural railway crossings, too. After all, everyone should just "look", right? Oh, and those stupid beeping back-up signals on big trucks. I mean, how hard can it be to see the damn thing moving!!

I saw a documentary about this subject. I would think that IF you are suggesting what charge was more appropriate, and attempting to bamboozle a person with your attempt on legal BS, you would at least look up things and know that there is no such charge as "Impede Traffic" in the HTA.

I think this type of defense is used to dispute the speed listed on the ticket. You are challenging the listed speed alone, not trying to establish the "true" speed.
You are arguing that the Crown must prove the actual speed is what is written on the ticket, PERIOD.
Not sure if it will work... Lots of info here:

When you deal with the prosecutor, try to negotiate a deal that will save HIM the most time. Perhaps explain to him that you plan to ask the JP for a Continuance while you seek legal council, but you would be willing to plea guilty to a lesser charge to avoid a trial, thus saving both parties preparation time.

It's absolutely clear to me that the intent of the stunt and speed laws was to control competition "AT SPEED"... NOT ACCELERATION. No where does it describe any offense as it relates to acceleration. There is big difference between speed and acceleration. Hard acceleration can be accomplished without breaking any speed laws.

Careless Driving is intended to apply to drivers' who's actions would be considered inadvertent or negligent. I wouldn't think this section applies to your situation. The insurance companies will ultimately determine fault for their own purposes, irregardless of any police charges.
It's not likely any fault will be laid against the other driver, and a Judge would likely state that your son chose to proceed despite insufficient visibility, so he's at fault.
