Re: Fatal error: Speeding 75km/hr in posted 60km/hr zone.
The example TicketCombat uses is:
- unknown offence (e.g. speeding 70kh/hr in a 64km/hr zone);
What they are trying to comunicate is that 64 km/hr is not a known speed limit. All valid speeding tickets state the speed your are charged with going, and what the maximum speed for that zone is. If the officer just wrote speeding, how do you ...

Re: Prosecutor mentality re deals, I don't get it, enlighten
In my own experience, I was charged with careless for being hit from behind into the car in front of me. Prosecutor offered failure to turn left to avoid collision. Fine. I accepted it. When brought in front of JP, he asked for clarification of events from prosecutor. he then questioned them on how I could have turned left from a stopped position ...

I got bit by this too. I purchased the "Used Vehicle Information Package" and gave it a read through. I followed all the steps outlined in the package when I sold the car. Then, just like you, I get a call from the police a few months later about that car. The 19 year old guy didn't register the car.

Don't know your daughters exact scenario, but here is something to consider. The standard that drivers are held to is not one of perfection. In R. v. Beauchamp Justice F.G. Mackay stated that "the law does not require of any driver that he should exhibit 'perfect nerve and presence of mind, enabling him to do the best thing possible.' It does not ...

...The other driver will also be summoned to court for your trial. They will provide evidence for the crown against you, basically they'll say something to the effect of, "you drove into their car and damaged their bumper". If the other driver fails to appear at your trial date, then the crown will most likely withdraw the charge because w/o the ...

I guess now you just wait and see? If it does get recheduled, increases your likelyhood of filing an 11B I would imagine. The crown decided to cancel court trials that day, not you

Re: fax confirmation, no copy of fax
So I recently faxed in my disclosure however my fax machine only prints out a confirmation that said it was successful to the number. But it doesn't show a copy of what I sent. Is that enough or should I try to find a machine that faxes and shows what I sent in the confirmation? Any advice would be appreciated.

I have read that if you don't receive disclosure you can requested adjournment.
When the JP asks for your defense say you can't make one because you never received your disclosure and thus you were unable to formulate a defense against the charge. Thus you request to have this trial adjourned until the prosecution is able to provide adequate ...

I have consulted with xpolice and they noticed the date on my ticket was wrong, and suggested we try and get it dropped. To be honest I don't feel right about that as it truly was my misjudgment that caused the accident. I am just hoping to reduce it from careless and possibly lessen the fine. The officer recommended this, and said he had to ...

Re: Am I entitled to get paid to show as a witness?
Not to hijack this thread, but I have a hypothetical question regarding witnesses.
A witness gives a statement at the scene of the incident, but the defendant doesn't agree with the "facts" detailed in the witness statement. At trial, if the witness does not show, can the prosecution simply rely on the statement given. Or, perhaps, is the trial ...

Just got back from the courthouse from my early resolution meeting. Going in, my wife was pushing me to take a lesser charge and move on with it. I was adamant that I did nothing wrong, and didn't want to plea guilty to anything. So, this morning I sat in the waiting room. People were being called into 1 of the 2 offices to meet with the prosecutor ...

I received my disclosure last week. I have an early resolution meeting on Thursday. A few points of interest. In the officers notes, she makes notes of the damage to my car being on the front bumper. I had no damage to my front bumper. My REAR bumper is damaged with the impression of the licence plate from the car behind me. 4 1/2 months later I ...

Yes, you are 100% at fault.
If the damage is less that $1,000 you do not need to report it.

If we can agree that in this scenario the sign is invalid, (thus falling back to 50 km/h), could you not argue that this was a fatal ticketing error as it is an "unknown offence", since "58 km/h in a 40 km/h zone" is not a valid offence for this location?

Id start by requesting disclosure to see what evidence the officer has to support a careless driving charge. Based on what youve said, I certainly dont feel the charge is warranted nor would you be convicted. First attendance meeting might not hurt, see what the Crown says. If they feel the charge is unwarranted they might simply withdraw it ...

Middle car in sandwich rear-end. Careless??
Yesterday evening I was stopped in line at a red light. About a dozen cars were in front of me. I had a safe distance between the car in front of me. I could see its tires on the pavement. I saw the light turn green, and a few seconds later the car in front of me released the brakes and rolled forward. I let off my brake and rolled forward. A ...
