Re: Fail to Surrender 3(1) ticket. Need clarification.

Viper, I think there can't be as much time as needed. How about reasonable 5-10 min max in my eyes is more than sufficient.

Re: Driver's record and by-law vs OHTA convictions

I know that it can be viewed through ICON which is a court based records management system but I have never seen it on regular MTO Driver's Abstracts.

The average person expels /processes about 15mg of alcohol per hour. So you probably would have some high readings if you were caught driving the previous night.

I would suggest first attendance meeting if your jurisdiction has it.

its in the notes 178 meters.

So it would be just under 60 cm's. Your vehicle is much wider than that.

What the JP would have been referring to was on trial date. How ridiculous would it be if disclosure is sent to everyone that gets a ticket even if they don't ask for it. If you are at trial and haven't got it, im sure the prosecutor would just hand you a copy then you're stuck deciding what to do. You can ask for an adjournment, but its no ...

Re: G2 driver BAC over zero (31mg) should i fight it

Generally convictions stay on your "driving record " for insurance purposes about 3 years.

Off the top of my head, I believe it does carry an immediate 30 day suspension for violating your G2 conditions. You should know that most suspension stay on your record for in the are of 6 years. You can try to contest it but you will have to prove that ...

Re: A COP's written NOTES are only as good as it's ENTIRITY

Its most likely because you had brought up the conversation that you had with him. He can't bring up a conversation that he had with you and what was said without going into a voir
dire, (a trial within a trial to determine the admissibility of evidence/statements).

All the officer had to say that he didn't recollect everything as he didn't write ...

Seek advice from legal counsel. Your local phone book / yellow pages, should have lots of contact information for lawyers.

Re: 75 in 50 zone - how are my defense strategies?

Hi all,

Strategy 1
It is often that two officers share a lidar unit. One uses it as the other writes the ticket. From the notes it appears he was the one that targeted you and stopped you

Strategy 2
Accuracy, well it is accurate, and it has been accepted includng that said unit by the IACP International Association of Chiefs of Police ...

Re: 75 in 50 zone - how are my defense strategies?

ZiXiao, you confessed to speeding. Next time (hopefully there will be no next time), never confess to anything, it does not matter how tempting it is.

I will chance Strategy 3 in any case. You were solo so your next bet is to include traffic in the opposite direction (if there is any). At 178m, the laser beam expands and the registered reading ...
