Technically I believe a Part 3 summons could be issued for any offence under the Provincial Offences Act, even minor stuff. However Part 1 tickets are preferred for most minor offences because if officers issued Part 3 summonses for everything the courts would not be able to handle the backlog.

A parking ticket won't effect your insurance so you would only be out the $60.00 if you paid. On the other hand you have sure fire win if you fight it. Do you get paid vacation days? While the cop has to submit a regular ticket issued under part 1 of the Provincial Offences Act within 7 days, he has up to 6 months from the date of the offence to serve you with a summons issued under part 3 of the Provincial Offences Act. The woman who's information was leaked would probably have grounds to file a complaint with the Privacy Commissioner, but this shouldn't effect your case one way or the other.

Fortunately red light camera tickets do not show up on your driving record and have no demerit points attached to them. Since there is no entry on your driving record your insurance company will not find out about it. Still it is a $325 fine so it may be worth your while to speak to the prosecutor to see if they are willing to lower that amount.

The fact that you got a ticket while everyone else got a warning will not work as a defense in court, although I agree it seems unfair. However if you can show that the signage was inadequate then that could well work as a defense. What city did you get the ticket in? It looks like the officer did give you his copy of the ticket, so it is possible that the ticket was never filed since he didn't have a copy to turn in. I would call the court house listed on the back of the ticket and see if they have any record of that ticket ever having been filed with them. If the ticket is not on file then you are probably off ...
