Re: 168 in 80 on Hwy 118 Muskoka: Paralegal/Lawyer Refereral

Michelle Scott of Scott Paralegal, in Huntsville has some good fight in her.
I've already got a paralegal. I just wanted to discuss with some of the previous posters in the comments to provide some ongoing fodder for discussion.
Cheers,

And kudos to you for coming back with info. Lots of people post the issue and then disappear so we never know ...

It could also be that the marked cruiser had radar and got a reading as it was coming towards you. Your defence of feeling that your life was in danger will not fly. If you were being shot at, or had been rammed maybe but a car that had no negative Intel attached to it will not be accepted. You should have pulled over or at the least turned off the ...

Disclosure means sharing what evidence the crown has. You can't go asking specific questions which are not included. The time to do that is in cross.

Just reread the original post. Clearly not a mistake on the copper's part if it did go as you said.

If your story is how it happened I'd definitely be taking it further because that is a ridiculous way to do enforcement.

Re: 2 tickets, 2 different courthouses. Cop says Quota Syste

Personally I'd be calling the crowns and saying you want to deal with them together. You're either in one jurisdiction or the other. Maybe the cop finished one ticket book after the first ticket and picked up a different one for the seconds in error. If he intentionally sent you to two different courts I'd file a complaint because that is nonsense.

But if your licence was suspended then surely you were driving in Michigan immediately after the sentence. I think there will be little sympathy and your job will have to be that you just exercised poor judgement as opposed to a flagrant disregard for the law.

I had one run in with a Freeman. Drunk in Public and was going to get a warning and a drive home but managed to talk himself into Drunk in Public, Resist Arrest, Mischief, Assault Police Officer. Found guilty on all.

Re: little in the way of disclosure

I would query the penultimate question. I doubt I could ever pick out the driver of a vehicle that I ticketed 6-9 months before if they were in a group. That's why we say we identified the driver by means of a photo drivers licence.

The first thing is your roommate's mental health is the number one concern. Everything else is temporary. Do not let them drive. If they are that close to pulling into another vehicle then they must not be behind the wheel of a vehicle. It is fine to say that the other vehicle may not suffer much damage but the damage too the mental state of the ...

They will keep trying. If they believe you are intentionally avoiding them they can get an arrest warrant. Not saying they will but you may as well accept the subpoena.

What do you mean by a secondary offence?
Are you an officer/retired officer? I thought it was a common term. I even googled it before I posted to make sure.

Schreech, you are correct that I meant a secondary offence is one that you cannot be pulled over for. You get pulled over for the primary offence....i.e. speeding, then the officer sees that ...

You misunderstand... Any compelled information obtained (whether a statement or a drivers license) can not be used against ...

Agreed with the eye roll. You'd be laughed out of court trying you say that any identification should be thrown out of court because you were compelled to give your drivers license. Re: 2 tickets, 2 different courthouses. Cop says Quota Syste

This is the most bizarre thread. I personally have a huge issue if coppers are writing tickets for offences that don't exist. Plus quotas are nonsense and no officer should have to make up charges because there are so many out there.

If I even caught one of my recruits doing this I'd punch them in the throat !

I'm still interested in the OP's explanation for the different offences than those he related in the original post particularly where he made specific reference to the officer saying the charge might be dropped if a DL was presented to the prosecutor.

These are two tickets from the same ticket book (sequential numbering) so would be the same courthouse. Plus the charges are number plate light and headlight nothing about your licence.

I suggest you got stopped and got issued two tickets. Happens all the time.
