Re: 49 over in a fifty

The case deals only with the disclosure of the testing portion of the manual. That is disclosed routinely. There is no new information here:

Courts decision with regard to legal arguments

42. The court rules the portion of the radar manual with regard to testing procedures on the Atlanta laser is relevant to full answer and defence with regard ...

I'm glad it was an ok outcome for you. Sometimes talking responsibility for your actions is the best course of action.

Re: Speeding ticket based upon calculations

You can ask for them in disclosure. You won't get them so you'll then have to convince the Justice that he should order the Crown to get them for you.

He won't.

Re: STUNT DRIVING CHARGE - NEED ADVICE

I think you made the best of a bad situation. It would have been nice if the prosecutor had offered +49 but he's under no obligation to do so. At the end of the day it's a speeding charge albeit a high one but it's not stunting.

Good on you for coming back on to update us. Few do so thanks.

Re: Use of intermittent red light

I believe you have been misinformed. There is no differentiation between stopped and moving...the Act simply says carry.

Red and blue lights to the front restricted
(14.1) In addition to the lighting requirements in this Part, a police department vehicle may carry lamps that cast red and blue lights, but no other motor vehicle shall carry any lamp ...

I was under the impression that headlight modulators were legal in Ontario on motorcycles.

I'm a bit confused. What is happening on the 20th ? Is it the trial date ? What happened when your grandmother attended ?

Re: Licence Plate Obstruction

There is almost a zero chance of the other charge being laid. Unless the OP was extremely memorable through poor attitude or some other reason this would just be one traffic stop among many for the officer. To prepare a summons, send it off to be signed by a JP and then to have to serve the OP just isn't going to happen.

Besides which it would ...

Fine is unpaid, licence is suspended thereby invalidating insurance, traffic stop is made and vehicle towed, family safe at a restaurant.

how does the written will of men and woman known as the legislature (statute) apply to me because I'm standing in a geographical location? (the real answer is guns)

The laws are made by people elected by the people. That gives them their authority. It's called democracy as opposed to the anarchy that Freeman on the Land subscribe to. If ...

jsherk is absolutely right. How on earth can you be ready for trial when you don't know the evidence against you ? That's nonsense.

No, if the notes say the test was done then the test will have been done. There will be an area set out for it and it will be done the same way every time. The officer will testify to that.

Re: 44km/h over - 5 Great Questions Inside :)

Hey guys, I got some great advice so far on here, thought I would pick your brain a bit more :)

1) With the above being said, I understand that it's extremely unlikely that the prosecutor will drop the case in the ER for whatever reason, especially without me having full disclosure.

This makes me not even want to attend ER. If I don't go to my ...

I would suggest that vehicle speed is target speed, patrol speed is cruise speed.
