I dont believe its possible to get a suspension removed from your record unless it was given in error. If the suspension was valid at the time, its permanent. This includes administrative suspensions such as street racing, even if youre found not guilty at trial.
Just an FYI if this is why youre asking, any administrative suspensions (i.e. stunt ...

Re: The Fast Lane
Here is a question , for those in the know and it leads into the issue I mentioned in the prior post, if you see someone merging onto the highway from an on-ramp is there a law that says if you are in the right lane you have to move to the middle lane to let them in? (I suspect there isn't but could be wrong and can't remember)

Re: Need help asap
I cant answer for certain, but its possible. All Provinces have a full reciprocal agreement with one another, so they share conviction information, etc. So in your case the seatbelt ticket you got in Quebec will show up on your Ontario abstract, with the appropriate demerit points applied. Im not sure if that suspension can be carried over to your ...

Re: valid speeding defence?
The short answer is possibly. It would depend on the location, limit and sign placement. As HwyBear said, the HTA lists "default" speed limits of 50 km/h in town and 80 km/h on highways. If the posted limit was the same as these, I don't think you'd have an argument. If the limit was something different, you may have an argument. Keep in mind, the ...

Re: Thanks giving weekend on HWY138
What I find funny is that I am noticing a pattern to all of the speeds reported in these posts. I myself was caught for going 32 over as well as many others. Seems these lidar guns like to throw out 32 as a number? If you look at the various posts in various speed ranges the numbers are always the same???? What is the chance of that?

I don't think you're interpreting section 148 correctly. It says pull out to the right, not pull over to the right. In other words assist in letting other vehicles pass by sharing the road.

Re: NEED HELP TO REDUCE FINE!!!
You can try pleading guilty with an explanation to the Justice of the Peace. Typically they'll reduce the fine by half, not sure if you'd get it down to $100 though. You can also try working out a plea deal with the Crown to a reduced fine, but again I'm not sure you'll get that much of a reduction. You can also ask for an extended period of time ...

Your licence would not be suspended for unpaid parking fines, only actual Highway Traffic Act tickets. Go to your local MTO licencing office and they can advise what you owe in fines and for what.

Yes, it should be considered a fatal error, but I'm simply saying the Courts don't always notice them. If that's the case you have to have the matter reopened and point out the error.

Re: Fatal error? Ticket date off by 7 months.
I was debating whether or not I wanted to fight it or pay it based on thsoe grounds, however upon actually reading through my ticket, I noticed that the officer wrote the date as Feb. 16, 2011 (My bday is feb 16) and so from what Ive gathered this means my ticket will either be quashed or just not filed right?

If you've got a clean record, I can pretty much guarantee they'll offer you a plea deal to reduced speed.
Points are automatically added on conviction, they're not recorded on the ticket itself. You're looking at 4 points for 32 over. Get it reduced to 29 or less for 3 points, 15 or less for no points.

Re: Careless Driving (in Inclement Weather)
General consensus on these forums is that for a careless driving charge, legal representation is recommended. Its considered a major conviction by insurance providers, and youre rates could double.
The good news is that prosecutors are usually quite willing to offer plea deals with careless driving charges to something much less serious (i.e ...

Re: Leave Roadway - Not in Safety
I'm thinking it's section 142(1), typically known as "Turn not in safety".
The driver or operator of a vehicle upon a highway before turning to the left or right at any intersection or into a private road or driveway or from one lane for traffic to another lane for traffic or to leave the roadway shall first see that the movement can be made in ...

Re: HTA 144 18 Failing to stop red light: making right hand
1) You can try and fight any ticket. How successful you are in Court will depend on the evidence against. Sometimes a plea deal to a lesser offence is the better bet.
2) Demerit points are usually irrelevant with insurance as they just look at convictions. They may overlook one minor conviction, the only way to know is to contact your actual ...

Re: Wrong make of car on ticket
It *may* be enough at trial to be found not guilty (creates reasonable doubt), but I don't think the Crown would simply withdraw the charge.
Maybe someone with more experience dealing with Toronto parking will have a better answer, but I imagine it would be easier to pay then fight.
