Re: Red Light traffic tickets
You might want to talk to a paralegal about this one. Or, you could try to work out a payment plan with the city of Brampton or the collection agency. Either way, it doesn't affect your insurance or driver record... although you cannot renew your plates until the fines are paid (as Stanton said).

Your insurance company may not hike your rates, provided that this is the only ticket on your record in the last three years. It all depends on which insurance company you have. I'd accept the deal. I like 100% odds.

Re: Disobey Stop Sign and Fail to Surrender Licence
If you are sure that you fully stopped your vehicle for even a microsecond, you could testify to that in court. However, the outcomes generally aren't that great. The best thing for you to do at this point is pick option 3 and arrange for a trial. When you get a trial date, you can file a disclosure request (please see the "Courts and Procedures ...

Given the circumstances, I think you did fine. You got a reduced fine and lower demerit points. Whether your insurance will be affected or not remains to be seen, but in some cases, they'll forgive one ticket per three-year period for things like:
- Speeding 15 km/h or less over the limit
- Disobey sign (what you pled guilty to)

Just for clarification... that is the MTO record and the record that police have access to.hwybear wrote:Any conviction under the HTA will go on your driving record and remain on the record for life!!!!
Your driver abstract and your insurance abstract will only list tickets like this for a period of three years.

So I am not sure if it was worth to hire the lawyer, because probably the insurance will go up and maybe with the same amount.
Your insurance probably will go up, but I do not think for a second that your insurance will go up as much as if you got hit with 49 over. Most insurance companies consider this to be a major conviction. Some companies ...

Well... I'd take the 15-over if I were you. But that's just my opinion. My current insurance company will forgive one or two minor speeding tickets (15 or less over). Some insurance companies make everything count. They do not all use the same risk assessment matrix, so I can't say for sure how it would apply to you specifically.

Re: Ticketed for doing 135 km/h on the 401 in Cornwall
Having relocated from Canada to the US and back to Canada myself, here's the run-down... Basically when you go to exchange your driver's licence, almost every DMV/licensing office will check with MTO for convictions and unpaid fines. It is true that Ontario traffic convictions will show up on your driver licence only if you are from New York or ...

A lot of the information on ticketcombat's website is out of date. Do not use a 4F; that is for civil court. Re: Could I plead with the JP?
First and foremost, the JP has no authority to waive points. This is administrative, done by MTO. When MTO finds out that you have been convicted, they will automatically apply 3 demerit points to your record. The JP can reduce the fine, but if you've been convicted, the JP can't suddenly reverse course and reduce the charge. That would defeat the ...

I'd say that if both tickets were issued during the same event, then include a copy of both tickets. If they are from two separate traffic stops, then you'll need a whole new book for sure.

You could ask for an adjournment, but have a really, really good reason as to why you need more time. This also would, obviously, stop the 11B clock.

Re: Failure to stop at red light - making left turn lane
If you can testify that you were already in the intersection, and just waiting for traffic to clear, there is a chance that will be accepted as a defence. You'll have to clarify with the officer: Where are drivers supposed to stop on a red? Are they allowed to remain in a crosswalk? Is there any law that states that only one vehicle may enter the ...

Prepare a long list of legal arguments to support your 11B. Go to the CanLII website and start looking for evidence to back you up. The more evidence, the better. Prepare a speech so that you can bombard the Prosecutor with overwhelming evidence. Then think of possible statements the Prosecutor may use to counter your initial argument. Think of ...

Pick option 3. When you get your trial date, you can request disclosure of the evidence against you (in this case, the officer's notes). Then you can figure out how much a defence you have against this charge.

Call Court Services and see how it's going. It isn't unusual in Toronto for them to take 8+ months just to schedule a trial... but I'd make the call anyway.

The officer is correct. Look at subsection (6) again:

Were you charged with Following Too Closely? If so... this charge is beatable unless a collision actually occurred. I'd suggest talking to a paralegal about it, because there are some complicated legal arguments that can be used. Otherwise, there is some case law out there that works in your favour, or you could plead it down.

Ah yes, the famous speed trap where the cop sits right near the gas station and nails you as you come off the ramp. They'll stop you for 10 over coming down that ramp... even though 60%+ of the drivers are going 20 or more over the limit, and the 10% who are going under the limit are going to drive through the red light at Parliament anyway...

Be careful. In some courts they do that, but in others, if you have not checked in with the Prosecutor, the Prosecutor announces "the defendant is not present." Then JP simply examines the certificate to see if it is complete and regular, and if so ...

I'd say go for the 11b. If you did make a documented disclosure request, and the Prosecutor had the opportunity to contact you to indicate the information was available, the delay should be charged to them.
