If there was definitely a median, you should be able to get the charge dropped or beat it in court. This is part of section 175 of the Highway Traffic Act, which deals with school buses:

What I can gather from the notes (perhaps hwybear or OPS Copper can correct my mistakes):

- Patrol highway 401 westbound west of Toronto Road in lane 3.
- Observed Target Motor Vehicle (TMV) in lane 1 at high rate of speed (HRS)
- I activated rear antenna
- Observed target speed of 130 km/h, patrol speed of 106 km/h

What about delaying the trial itself?

You or a friend can appear before the JP and ask for an adjournment. They will not really require substantive proof for this, but have it ready just in case.

As for proof - do you mean that I need to provide them with proof in the form of actual pictures?

It's a bit late to try to construct a solid defence here... did you happen to get disclosure of the evidence against you? If not, no big deal, but what I'd suggest is try to look for a plea-bargain to a municipal by-law infraction, if the officer shows up. The crown tried to say the late disclosure was due to my error and late request, but I told the justice that the reason for the late request for disclosure was due to the PO Office's failure to provide Notice for Trial.

That should keep the option open to stay the charge later, depending on when they re-schedule it.

The best strategy is to request it as soon as you have your trial date. I'd still make the disclosure request regardless.

Just don't tell anyone that the ticket bears the incorrect set fine, otherwise, if it is within 6 months, they can withdraw the original charge and issue a summons in its place! If the case goes to trial and you don't appear ...

The 10th pedestrian fatality happened this morning on Dufferin Street. A woman jaywalked in front of a Honda Odyssey who attempted to avoid the collision, but despite the efforts of the driver, the side mirror struck the pedestrian and knocked her down where she struck her head on the pavement. She died at the scene.

Depends on the make/model and weather conditions, the specifics should be in the radar manual. You can bet that it would be at least 1 kilometre, if not well above that.
