Try to plea-bargain to a municipal "disobey sign." It does not need to be a "non-moving violation." Statistically senior citizens get into collisions mostly at intersections controlled by traffic lights and signs. Maybe the province should look at mandatory re-testing every few years instead of banning them from the 400 ...

The pilot is not doing the observation. Odot has a spotter in the back of the plane who is watching the traffic and radios to people on the ground. You'd need to get the notes of the officer who was in the plane to see if he saw the vehicle cut you off... as the officer who stopped you indicated.

I'd say it's safe to say the officer will show up, mostly because it was the Peel Region Police (I'm assuming) that stopped you. They show up usually 60%-70% of the time. Toronto is more like 50%.

I definitely plan to defend myself in a clear and concise manner, but I don't have any experience in this situation.

That's a weird one... if you pay you'd get 2 demerit points plus the possibility of an insurance increase (maybe not because you have an unblemished record).

Another option is setting up a trial and looking for a plea-bargain to a municipal by-law infraction. Most of them do not have demerit points so they won't go on your driving record. It's one ...

If your testimony is consistent, in that you turned right on an amber light, and you are not swayed or shaken by the Crown when you get cross-examined, you would have a chance of being found not guilty. Yes. After you get your trial date, you (or a paralegal) can file the paperwork for disclosure. What should be included (and you should ask for) are the officer's notes, a copy of the collision report, and any photographic evidence (assuming that they have any).

No. The location does not have to be pinpoint accurate. Minor spelling errors also won't make it invalid. What would make the ticket invalid is if the location was missing entirely, or did not exist.

Everyone just left the cyclist there to fix herself up because of her hostility

It's almost remarkable that one of the pedestrians that she almost slammed into did not knock her back to the concrete.

They are insane for the most part - speaking of the courier guys.

If there was definitely a median, you should be able to get the charge dropped or beat it in court. This is part of section 175 of the Highway Traffic Act, which deals with school buses:

- Patrol highway 401 westbound west of Toronto Road in lane 3.
- Observed Target Motor Vehicle (TMV) in lane 1 at high rate of speed (HRS)

You or a friend can appear before the JP and ask for an adjournment. They will not really require substantive proof for this, but have it ready just in case.

It's a bit late to try to construct a solid defence here... did you happen to get disclosure of the evidence against you? If not, no big deal, but what I'd suggest is try to look for a plea-bargain to a municipal by-law infraction, if the officer shows up. The crown tried to say the late disclosure was due to my error and late request, but I told the justice that the reason for the late request for disclosure was due to the PO Office's failure to provide Notice for Trial.

That should keep the option open to stay the charge later, depending on when they re-schedule it.

The best strategy is to request it as soon as you have your trial date. I'd still make the disclosure request regardless.

Just don't tell anyone that the ticket bears the incorrect set fine, otherwise, if it is within 6 months, they can withdraw the original charge and issue a summons in its place! If the case goes to trial and you don't appear ...

The 10th pedestrian fatality happened this morning on Dufferin Street. A woman jaywalked in front of a Honda Odyssey who attempted to avoid the collision, but despite the efforts of the driver, the side mirror struck the pedestrian and knocked her down where she struck her head on the pavement.
