Re: Tint law on new vehicles

They updated the safety checklist in 2015. If you have a car built after 2017, they check for tint before you can pass.

Yes, I found that checklist. However the Ottawa Police Service Traffic Section has been laying charges for 2017 vehicles with tint exceeding the legal allowable limit. I am at a loss to find the charge for this.. they havent ...

Tint law on new vehicles

I was unaware there was a tint law that came into effect for vehicles manufactured post Jan 1 2017. I read the article here :

http://www.cbc.ca/news/canada/windsor/ontario-limits-amount-of-allowable-window-tint-cyclists-rejoice-1.3657694

However I am unable to locate the charge , charge wording, set fine , or relevant sections should someone ...

Is it possible the officer may have amended his copy and the JP accepted it ? Maybe JP ruled it would prejudice your defence ? Interested to know what happens.

"The system" does not include the computer network that the police use. If anything, some access to some users may indicate whether the vehicle is insured or not, but the is based on the information that is submitted when a validation sticker is renewed. This information is usually not accurate or incomplete. You still have to carry your valid ...

There is no interview for G1/G2 drivers. It is automatic suspension.

Surrender your license ASAP to get the 30 days over with.

Just to touch on what JSherk posted.

This is my son's first offence.
He did not pay his insurance for 2 months. He was charged with no insurance.
What suggestions do you have for him to address his issue?
His court date is in April.
He works hard and is a good young man outside of making a very serious mistake with poor money management.
Any suggestions are welcomed?

The council may propose the change but it will have to be passed through a change in the legislation if the police are to accept them. If you read this board you will see differing opinions on Early Resolution. I think it's a good idea and that you are likely to get a better deal before the Crown has spent time working on the case and getting it ready for trial, calling witnesses etc. Once trial day arrives he or she is ready for trial so may have less incentive to cut you a ...

Re: Making Statements to Police Officers

I understand that HTA 199 obliges drivers to report, "the particulars of the accident," to police only when damages exceed $1000.

Since there are no damages in this case, I would think that the driver is under no obligation to state any particulars of the accident.

However, suppose there was $1001 worth of damage. Suppose the driver struck the ...

If your holding it, that's all that is required, doesn't matter where, stop light etc, if the engine is running and your on the road i.e not pulled over and properly/safely stopped.
Clean record doesn't matter
I don't think it can be reduced as there is no other charge to reduce it to,

Others will be along to corroborate and offer advise

Was that 5-6 pages of notes for a reduced speeding ticket ? I've seen less notes on a stabbing file. Be prepared to be convicted of 75 km/h in a 50 km/h zone . Unless the officer doesn't show which happens very rarely.

I think argyll hit the nail on the head. Remember why you are going to court this argument has no bearing on your charge. Police are exempt from various parts of the HTA s128 is one of them . Focus on your cross examination questions not the fact the officer was speeding, was he in the performance of his duties. I would almost bet he will say yes ...

The operator shall surrender it for inspection upon demand. The operator shall not search their car for it upon demand because they cannot find it. Which could put the operator in danger let's say it was on a 400 series highway in the shoulder the officer may not have wanted a fatality collision on his hands .

Depending on the officer he or she ...

All tickets are fightable... but these ones are next to impossible to beat, unless the officer does not show up (which is very very rare).

However it is always worthwhile to plead not guilty, request a trial, and request disclosure and then show up on the trial date because as a worst case, you can probably get the fine reduced on both of them ...

So you admittedly didnt stop and got a ticket. The reason you feel like the officer gave you an ''all in'' ticket is because $325.00 is the fine for ''Red light - fail to stop s. 144(18) HTA''. This isn't a speeding fine where the officer can choose to lower the fine.

IF you were on a bicycle and its checked off on the ticket than the convicting ...

I would choose the NOT GUILTY option and request a trial with the officer present. Once you get your notice of trial, you can request disclosure (officers notes). Once you get the notes, blank out personal/officer info and post here so we can review.

You can always plead guilty and pay at anytime up to the trial without penalty. But you should ...

Yes, police can check the insurance ''status'' of your vehicle by running your plate on MTO. If you don't have insurance it will show up on the computer as ''UNCONFIRMED'' in big red letters. The system is usually correct, I've personally never seen it wrong as long as its been out.
