Was the bus completely stopped, or slowing down?

Re: Fatal error: Speeding 75km/hr in posted 60km/hr zone.

The example TicketCombat uses is:
- unknown offence (e.g. speeding 70kh/hr in a 64km/hr zone);

What they are trying to comunicate is that 64 km/hr is not a known speed limit. All valid speeding tickets state the speed your are charged with going, and what the maximum speed for that zone is. If the officer just wrote speeding, how do you ...

Re: Prosecutor mentality re deals, I don't get it, enlighten

In my own experience, I was charged with careless for being hit from behind into the car in front of me. Prosecutor offered failure to turn left to avoid collision. Fine. I accepted it. When brought in front of JP, he asked for clarification of events from prosecutor. he then questioned them on how I could have turned left from a stopped position ...

Re: please reply , really worried :(

I got bit by this too. I purchased the "Used Vehicle Information Package" and gave it a read through. I followed all the steps outlined in the package when I sold the car. Then, just like you, I get a call from the police a few months later about that car. The 19 year old guy didn't register the car.

Fortunatly for me, I was being contacted ...

Re: Getting a professional opinion

Don't know your daughters exact scenario, but here is something to consider. The standard that drivers are held to is not one of perfection. In R. v. Beauchamp Justice F.G. Mackay stated that "the law does not require of any driver that he should exhibit 'perfect nerve and presence of mind, enabling him to do the best thing possible.' It does not ...

Re: Careless driving ticket at Reporting Center

...The other driver will also be summoned to court for your trial. They will provide evidence for the crown against you, basically they'll say something to the effect of, "you drove into their car and damaged their bumper". If the other driver fails to appear at your trial date, then the crown will most likely withdraw the charge because w/o the ...

Reminds me of something read on Ticket Combat wesite and the Family Day holiday
http://www.ticketcombat.com/step1/odds.php

I guess now you just wait and see? If it does get recheduled, increases your likelyhood of filing an 11B I would imagine. The crown decided to cancel court trials that day, not you

Re: fax confirmation, no copy of fax

So I recently faxed in my disclosure however my fax machine only prints out a confirmation that said it was successful to the number. But it doesn't show a copy of what I sent. Is that enough or should I try to find a machine that faxes and shows what I sent in the confirmation? Any advice would be appreciated.

Most fax machines have options to ...

Re: Nabbed on the 400

Thanks for all the help. I was wondering if I should show up with any case law, to bolster my request for dismissal due to missing, inadequate, or in-timely disclosure?

You are not looking for a dismissal of the charge. You are simply looking for an adjourment. You can just say that your requesting an adjournment in order to give the crown time ...

Re: Nabbed on the 400

I have read that if you don't receive disclosure you can requested adjournment.
When the JP asks for your defense say you can't make one because you never received your disclosure and thus you were unable to formulate a defense against the charge. Thus you request to have this trial adjourned until the prosecution is able to provide adequate ...

Re: Rear End - Careless driving.

I have consulted with xpolice and they noticed the date on my ticket was wrong, and suggested we try and get it dropped. To be honest I don't feel right about that as it truly was my misjudgment that caused the accident. I am just hoping to reduce it from careless and possibly lessen the fine. The officer recommended this, and said he had to ...

From what you said, IBC rules state the other driver is 100% at fault

Read it over and find your scenario
