Not sure you'll be successful with the touching the phone argument. I would imagine the counterargument would be that you should have securely mounted the phone in a position much higher up than a cup holder and that looking down at the phone in the cup holder is in fact dangerous. Good luck

Thank God for the Partridge. As an LEO I always lay the Careless. But I never get a court slip for trial. It always and I mean always gets negotiated down. I recommend early resolution and see what the offer is. Likely follow too close.

K so I called an insurance company anonymously to inquire and the individual said it results in a "minor conviction," and that indeed it will result in an insurance increase.
So I keep hearing that non-moving violations don't result in an increase but this doesn't appear to be true. Any excuse these jackals can get they will take apparently ...

You knew the rules and you broke them. The situation has no bearing on things and does not need to be considered. What you need to do now is try to find a way to minimize the effects of this charge, and if I were you I would not bring up the situation as you described it at all - no one will be sympathetic to your sob story.

Why would you want to add extra lights that only serve to draw attention to your car.? I like to be as inconspicuous as possible.
As far as green, I know that's the colour used by volunteer firefighters.
Amber should be allowed, yes, but not flashing.

I would not imagine that the court will go easy on you given your record of prior use of hand held device convictions and that you flipped off the officers. So unless there is a fatal error on the ticket or if there is something in the officer's notes that will help my guess is you will be convicted of this. The excuse of taking kids to the doctor ...
