Re: If Charged with Careless while in Accident, how to fight it?
No worries. I can fold the screen in if that's the issue. I don't play with it while driving (no need really). Just hit record when I start the car. I highly doubt the gadget law will affect dash cams. If it does, I'll find a way around it.

Won't happen to me. If someone lane/brake checks me, I'll have all to evidence I need ;)

Re: If Charged with Careless while in Accident, how to fight it?
Our oldest boy faced this exact same scenario a few months back. Because it was his first HTA offense AND it is a very serious charge, we decided to pay the $400 to hire a paralegal. The Crown would have to call both the officer and the victim to the stand to successfully win a conviction. Neither showed on the court date and the careless charge ...

Re: Fail to obey signs when passing an OPP cruiser
That's one heck of a comma! If you are right, then basically the definition of a stunt is anyone driving without consideration to other drivers. That basically takes out every driver in TO. Hey, maybe that was Fantino's plan all along: revenge for TO firing his a$$!

Re: Fail to obey signs when passing an OPP cruiser
I ain't no English professor (hehe), but I believe the " By " being on the left of the comma restricts subsections i to iv to "[C]" only. If the " By " had been on the right of the comma, [A], AND [C] would have been associated to subsections i to iv.

Re: HTA172 and police conduct
I do not know that. I have heard the usual going with "the flow" blah blah blah defence heard in court thou, with a conviction still at the clocked speed. JP basically indicated that just b/c someone does "X" speed unlawfully does not make it lawful for anyone else to drive at that speed .

In order to affect the points, the charge has to be changed. This happens all the time. It's normal court procedure.

But it doesn't say that. Surely you're not suggesting this section of the Act isn't worded clearly enough
