Suspended Sentence

Unread post by Sue »

Hey guys, just need some clarification.

I was charged with driving while suspended. I was unaware of the suspension and once became aware I paid my fines and re instatment fee to obtain license again. At court I recieved a suspended sentence. What does this mean? Can I drive?

Thanks so much,

Sue

Normally there is an additional 6 months suspension added if you are convicted of driving under suspension. That is administrative, applied by MTO after the court date. The thing is, the court really won't advise you of that. Best bet is to call MTO and confirm with them.

As for the suspended sentence, it means that nothing was tacked on to your licence.

Just to clarify - you did plead guilty to Drive under Suspension, correct? Or was it Drive with No Licence?

* The above is NOT legal advice. By acting on anything I have said, you assume responsibility for any outcome and consequences. *
