I can't speak for the officer, but I would presume that if they were going to charge you with anything else, they would have.

Very valid question. If you had several months notice and didn't act on it immediately, that may lower your chance for getting an adjournment.

Re: caught driving with suspended license 5 times

Its another offence to drive in Ontario under the jurisdiction of another licence when your Ontario licence is suspended.
You need to come to grips with the fact that you are in all likelihood going to jail for a period of time. Running away only prolongs the inevitable.
You should start making smarter decisions.

Re: Anybody have copies of most recent Genesis II manuals?

"Winning" an appeal is one thing, getting off because the Crown didn't want to contest it is another completely. Besides, this is provincial offences court. No precedence would have been set.

How about you thank your lucky stars you didn't get charged for dangerous driving or flight from police? Pretty stupid move on your part.

Re: Novice Driver - BAC over zero - Possible courses of acti

I could be wrong, but I believe that you get your license back from the police after 3 days. The 30 day suspension you need to have it reinstated.

You do not get your licence back from the police. If it was suspended for a warn range suspension, it gets returned to the MTO. Once the suspension is over, you have to pay a $150 reinstatement fee ...

Re: Speeding charge - Do I qualify for 11(b) - Need advice

I said I would like to motion for 11(b). He asked me what is the reason. I said that it has been 14 months delay from the date of charge and due to no fault of my own and that my right for being tried within reasonable time has been infringed.
It is partially your fault. If I understand your info that you provided, you were not ready to proceed ...

Re: HELP!: Novice driver - B.A.C Above Zero

You're not telling the truth. There is no way possible that you had a few sips of wine and a beer, then an hour later, blew an Alert (which means you had between 50 and 99 mg of alcohol in 100 ml of blood). It is next to physiologically impossible.

Re: Demerit Points reduced after the fact

Demerit points are administered by the MTO. Police, Crown and JP's can't do anything about it. We don't set them.

It's an average of 0.015 mg/% per hour. Some people are slightly lower, some are slightly higher.

Re: Questions about suspended license

It is not immediate either. It can take a few days to show in the system that your licence is no longer suspended. So do not expect to pay the ticket at 12:00 and be good to drive at 12:01.

Re: subpoenaed

I am starting to suspect that from your line of questions you lied to the police at the scene and later you cannot remember the details of what you said. That is why you are so worried about what they will ask. That you said something not true and now if asked you will not know what to answer.

OPS

All the prosecutor is required to provide you is the cover page (so you know what device it is) and the testing procedures. They have discharged their obligation for disclosure if they do that.

Re: Expired License Ticket

If everybody in Ontario choose the not guilty option and requested a trial then this would back up the court system and most would get off with charter violation of right to speedy trial.

Or guilty people could plead guilty and accept the consequences (commonly referred as "doing the right thing").
I often wonder how many people, knowing they ...

Re: Can I fight to get a suspension stricken from my record?

Insurance companies do not use suspensions for unpaid fines against you.
That is completely incorrect.

"MTO does not send a notice of suspension to insurance companies. Insurance companies do have access to a driver's driving record through the Authorized Requester Program. An active unpaid fine suspension will appear on an abstract, but once ...

There is nothing preventing the Prosecution from doing this. I see it regularly in my area. Yet another reason I don't reduce tickets.

The phone can be visible. There is nothing preventing that. Basically, if you have to touch the phone to answer it at all, then it is distracted driving.
