hwybear, why can't you guys (or the gov't legislate it) so that when you pull a car over, they MUST EXIT the highway? Why must we keep putting officers lives in peril when the simple solution is to stop pulling cars over on the shoulder? In a built up area, highway exits are frequent, so there is no reason why this cannot be done.

I am extremely polite when I get pulled over, but don't recall any officer asking me why he pulled me over... they usually start the converstion by TELLING me I was clocked at doing xx km over...... getting a ticket is very business like and quick these days.

I don't get any breaks anymore. Meaning, I don't ever get let off with a warning, even ...

I buy that, but what I am trying to do, is establish doubt.

What if there were two similar looking cars in the traffic flow? The airplane observer cannot tell the difference from a blue Acura and a blue Civic, can he? There is some doubt to EXACTLY which car then that the land officer has to pull over.

I didn't pick up on the sarcasm, but I get it now ... I am really pissed by this ticket..... I wonder if it's simply a matter of me being the only guy actually speeding at the time ... maybe no one was driving unsafe (30-50 over), so, in order to justify the cost of the airplane, they have to keep writing tickets in a certain time frame. I was on the 400, so there are no pedestrians allowed.

In remote parts of HWY 11, I see no problem doing 10 or 20 over, but in the built up areas, where you are probably referring too, then of course, I'd slow down.

My point is that I find it silly using an airplane (and all the costs asscoiated with that), to catch a guy doing 21 over when it's ...

If the Proesctuor and JP's are not lawyers, they can be intimidated (in a nice way), by bringing Charter arguments. If you dress the part (look like a lawyer), and bring a brief case (assuming you filed all the appications ahead of time), this may work to you advantage. You may at least look like you know the law.

hwybear, I didn't realize the observer had constant sight of the vehicle, but it makes sense now ... although, in court, he can't honestly say "I observed a red 1998 Camero exceeding the speeing, now can he? .... I guess it's tag team in court between him and the ground officer..

I am a little upset on this one as I was only doing 121 in a 100 ...

racer , I get the attention of that guy (with the loud music) to open his window. I then yell at him (using a friendly voice) ..." hey, can you hear the song on my radio?" ... he usually says "no", so then I yell at him, swearing and all angry like ... "then I don't want to hear your f&*#@ music"...

kend7510, your best defense is the officer not showing up, but don't count on it. And, since you were speeding, you will likely be found guilty. These tactics (asking for disclosure), in my opinion, are just ways to use the system to have your case dismissed. They often work, but you have ot educate yourself by reading more and more sites.

Sorry COMBAT, I didn't mean to step on your reply... he can definetely use a form if he is more comfortable with that, but the Crown is wise to these templates and forms and know it's just a tactic that they can easily counter. Plus a letter looks more like it's coming from a lawyer or paralegal and they feel just a tiny bit intimidated by that.

You do not have to fill out, or send in a form to request discloure ... all you do is send a letter (using your own words) to the Prosecutors Office (be sure to metion the date, offense # and big bolded letters "REQUEST FOR DISCLOSURE"). Make sure your address is on the letter but NOT your phone #. This is critical as you do not want anyone ...

I'm curious though, how can the areal officer (observer) testify to the altitude and air speed of the plane? I really think the pilot needs to a witness too. That makes it 3 witnesses. Maybe BOTH officers in the plane are pilots?

How does the aerial officer see that far to the ground? Does he (or she) use binoculars?
