Re: List of Fatal Errors
Doing some research specifically on Missing HTA Section and found this.

R. v. Hargan, 2009 ONCJ 65 in which an appeal based on missing section code was dismissed.
Has there been decisions since that affect this
It goes into analysis of previous decisions but of specific importance section 11,12,13 below.

Re: forcing fatal error
If fatal error exists on ticket and I already asked for trial what should I do next? Is my best option wait for trial and not show up, get convicted then head to JP for reopening?

Re: How to file an 11B
Thanks Radar Identified - but how can we fax such a large document? More-over do we not need their stamp on all other copies of the 11B? I've made 6 copies following the guidelines on this thread, but the books are so large I dont see how we could fax it or get them to stamp all our other copies.

Re: Disclosure reqeust and Stay of Procedings
OK now December and after 2 Disclosure requests first one June 3rd, 2nd one Oct 26. Filed for stay on November 14th and trial is about a week away. Was worried about the amount of time delay not being attributed to crown but with no disclosure and original offense date in Aug 2010, it will be 16 months since offense and 6 months since first ...

Re: Disclosure reqeust and Stay of Procedings
Since you put in your disclosure request so late, I'm not sure you'll be able to use the June to December adjournment towards an 11B. The delay will probably be attributed towards you, not the Crown.
Would it be attributed to me even though I did not get notified?

Disclosure reqeust and Stay of Procedings
Hi put in a disclosure request before my trial but I put it in late on June 3rd. I submitted late because I never received my court appearance notification (assuming lost in post because of 2 moves and Canada post forwarding). Only reason I found out my court date was I called and emailed POA periodically and once they had trail date and submitted ...

Police services don't receive any money from tickets....all goes to the municipality where the offence is issue. Municipality then can use the money as they see fit.

Re: Do I Have chance of successful 11b? HTA 136 (1)(a)
OK went to court today and as usually waited to talk to prosecutor and she said she was withdrawing the charges because of my 11b motion had valid arguments and she would not contest it. I just had to sit through everyone else until they called me up to hear officially that charges are being withdrawn. Couldn't have gone better in my books!

Re: Careless Driving / Accident with 2 other cars.
Ok had my day in court yesterday and no witnesses showed. Charges were withdrawn. Also I didn't mention before but I missed my first appearance. I got the times mixed up and showed up at 1:30pm for a 10:30am trail. Found out I was convicted and went straight to justice of peace with explanation to have the matter reopened. This may have had ...

Careless Driving / Accident with 2 other cars.
Hi I had and accident where I rearended on car who then rear ended another. Cop gave me careless driving based on witness (other 2 drivers) reports. It was a very bad spot on Gardiner EB near Spadina exit and cop said I was his 3rd of the day already at 11am in exact same streach.

Getting all my documents together. I think I have it all figured out but still a bit confused....
Is a Form 16B needed to file 11B/Form 4?
Is this only used if you have someone else representing you or if your using couriers?

Re: Do I Have chance of successful 11b? HTA 136 (1)(a)
No that wasn't me. I was not in Court room #B
So do I need a paralegal to submit for 11b/form4?
Another question where do I request for transcripts of my last court appearance to include in file. Is this the prosecutors office as well? Is there a specific form?

How long an offense stays on your abstract after trail
Hi I was hoping that if you took a charge to trail that it would actually be on your abstract less because it would be removed 3 year from offense date. I think however this is no the case since I have gotten my abstract and have a ticket still on today.
Date 2008/05/10, offense date 2007/4/10. Still on today 2010/11/10
