Now I'm not against people in Law inforcement, and althought most of this may be obvious, there's no harm in having a discussion about it. Not to resurrect a thread, but my case was adjourned once already, now if I bring this issue up regarding the Crown not providing me with

1) a manual of the radar
2) proper eligible notes that make sense.. the officer seemed to use some sort of short form notes for everything he wrote down..
3) calibration records for the radar to confirm it was ...

Thanks! That was what I was thinking.. I have a right to atleast see these documents, even if it's at the courthouse.

However when my court date comes, I'll make my argument that the crown has not notified me or given any notice regarding these documents which I requested in my disclosure letter (inadequate disclosure). Shall I print out copies ...

I've made several attempts to obtain this information but received no response, nothing that tells me that I can view this document at the court house. No explanation, nothing.

Thanks for the explanation :)

I'd like to use this argument in court, however since I don't have any official documentation stating that this particular radar.. when in POP mode, the constable cannot issue a speeding ticket to anyone.

How should I go about that? I've even gone as far as requesting a copy of the operating manual from the ...

Just checked the disclosure notes and it says "BEE III Radar System".

So yes it is used, by Toronto Police atleast. The test times for the unit that the officer included in the notes are about an hour before and an hour after what's written on the ticket. No note about whether POP mode was used. Not sure if this would help..

Requests for disclosure would help your end, seeing that you acted to seek out the evidence against you.

If the camera caught the wrong carwas it a different make/color/sedan or coupe? If it's clear in the photo they sent you that it doesn't match your plates, I think you could just bring in your ownership which states the color, type, make, etc.

This is the problem I'm having.. trying to decipher the officer's hand written notes which aren't helping me at all. But from the officer's writing, looks like Bee III radar that was used.. I'll double check tonight

I think the officer will know full well that the POP mode does not provide a tracking history.. it's stated in the manual (which they have responded to my request for one in my disclosure)

This may sound a bit daft, but what is a tracking history? I'd like to gain a better understanding of this if I'm going to use this in my defence.

I did some investigating on this unit and found some info regarding the MPH Bee III unit.

"Mph doesn't recommend using the POP Mode exclusively because it excludes getting a proper "tracking history" taken in this mode"

So if I get pulled over by an officer who used POP mode to tag me, can the crown/officer cannot use the radar evidence against ...

I think the rule says that disclosure is not to be mailed. You must pick it up.

I agree, I did what ticketcombat and other sources recommended, to not put my number on the disclosure request. In court, the crown and I talked about the disclosure (how I did not receive any), and he agreed to adjourn my case. When I was called up the crown already ...

Um.. I just received my Disclosure in the mail after offering no phone number on my registered mailing or backup fax.

I got a lazy prosecutor than :p

If you get disclosure in the mail, great. If you don't and show up in court letting the crown know you haven't received it, he can just give it to you right before court. Argue there is not enough ...

This may be too late, but for anyone else whose reading. I mailed my disclosure request via registered mail to the Crown 5 weeks before my trial, and my disclosure was ready 2 weeks before the trial. The Crown will not make any attempt in notifying you of this if you do not have a contact number on it. You have to pick it up yourself.

Thanks for your input everyone. I really appreciate it and take your advise into preparing my defense!

But when I'm infront of the JP, I don't want to sound like I'm trying to use strategy after strategy to try and get the ticket off should I? I'll try using the 11B Argument first, and if that doesn't work than I pull out an improper disclosure ...

I know this forum serves the general public well in guiding them through the procedures in court and how to prepare a proper defense against charges like speeding, but has anyone actually used the by-law missing from the disclosure as a way to have their charge withdrawn? The Crown has not provided me with this in my disclosure package.

Since I've already received Disclosure, I've done some research and came to the following conclusion.

A 40 km/h zone is not under the HTA, and since the disclosure did not include any documents noting the by-law that I'm being charged with, I can argue improper disclosure from the Crown.

Shall I discuss this with the Crown before the court is in ...

Hello, I came across this board after my 1st appearance in court last week. I'd be willing to share my experience in court with others on here and help out anyway I can. I'm no expert but after some research and discussion with paralegals, I've gained a bit of understanding on how to defend myself in court.. or atleast have a fair trial.

Thanks for the reply.

This all happened in my 1st appearance in court, 11 months after I received the ticket. My 2nd appearance will be 1.5 years after the actual offense date.

Now that I think about it.. I said in court that if the prosecutor had my mailing address from the disclosure request, could they not send me a notice telling me its ready ...

I recently attended court and had my case adjourned to a later date in 2010. Did you leave your phone number on the disclosure letter?

When I attended court the prosecutor said the disclosure was ready a month ago and that I did not come pick it up. I stated that they had my mailing address and couldve sent me a letter informing me it was ready ...
