11b After I Won The Appeal

It is getting interesting here. I was convicted on the first trial . i filed an appeal and i won it. The Judge desision was that my right were violated and ordered a new trial. Went on the new trial , but no trial was held because of no time. I did request to proceed with the trial , but the Judge refused. New date was scheduled and now this is going to be 18 months after the offence date. As the first trial was dissmissed by the appeal court does it count as my fault for the trial delay or I can file the 11b for stay of proceedings?

It is a new trial now with the original offence date and it is well over 18 monts after.

Any ideas ?
