Re: Hand Held Communication Device Court date tomorrow 04/04
The fine could increase to $1000 if you fight it and lose it's really up to the JP. The thing is, if you really didn't do it your only opportunity to contest the charge is by going to trial. If you present your side of the story without being belligerent the court is less likely to impose high fines even if you are convicted. You are going to have ...

Re: Disobey lane sign
If the date is clearly 2017, then you can try to force a fatal error by not responding to the ticket. The JP should quash it, if not you appeal. There is a lot of info available on this.

Re: (Photo Radar) Bill 65-Safer School Zones Act
Sorry but this legislation was not passed secretly, it was done so in an open forum like all other laws, and it was reported on by the press. It authorizes the use of automated speed enforcement in school zones and community safety zones where the limit is 80 or below, so at this point you will not see minivans parked on the side of the 400 series ...

Re: Passing the streetcar
You are required to come to a stop and stay 2 metres behind an open streetcar door, if you cannot stop in time to leave the space then do not stop. The trouble is that (unlike a school bus) there is no way to know for sure if a streetcar door is going to open at a stop to let someone on or off as drivers are not given any real warning other than ...

Re: Need advice about ticket and what the cop did
Sometimes is just easier to hire a professional and let them worry about all the nitty gritty, if there's a way to get you out of it or reduce the charge, they should be able to handle it.
If you want to try handling it on your own you simply request a trial, when you get your court date you then request disclosure. Make sure that you request that ...

Re: Expired sticker ticket
I would not expect that it be impounded for an expired sticker. He could pull the plates off the vehicle if there is a problem with it mechanically. Personally if I were you I'd either stop driving it or borrow the money to fix it right away, paying 3 tickets along with the large insurance hike associated with them is going to cost you a lot more ...

Re: STUNT DRIVING 183 in 70 KM - WAS NOT SPEEDING
Yes the system can suck for a person who is wrongly accused, but that is what trials are for. I'm afraid if you want help you are going to have avoid ranting and ask specific questions as they pertain to your situation. Likely the best outcome is going to be to plead it down to 49 over but seeing how the officer believes you were going much faster ...

Re: Major Defect in comm. Veh. HTA 107 (11)
It would be nice to know how the test was conducted. Some officers idea of a test is to have the driver activate the parking brake then put the vehicle in gear to see if the parking brake is able to hold the vehicle in place at idle. Others will do the same except they instruct the driver to accelerate. One is the right way, one is the wrong way ...

If the page of the pre-trip inspection was seized you will get a copy of it when you request disclosure.
Drivers mistakenly assume that if pulled over for inspection they cannot face prosecution for any defects discovered, arguing that they were not present when they completed the pre-trip.
The charge you mentioned is based on the driver ...

Re: Prosecutors are backtracking on disclosure of dash cam v
The video can do nothing, add evidence of you guilt, or exonerate you.
If two officers offer strong testimony against your weak testimony (especially one that contains an admission of guilt) then that would be enough to convince a JP that you are guilty beyond a reasonable doubt.
However, one way or another if you exercise all of your legal ...

Re: Disobey Sign & Interfere with Traffic?
I believe that the interfere with traffic charge is for when you stopped and waited so that you could safely make your left turn.
Request a trial and ask for disclosure, it comes all together. Most likely you'll plead guilty to the lesser charge and the other one will be dropped.

Re: Red light ticket, CVOR
The ticket does not go on the CVOR it is issued to the owner of the plate. In much the same way that there is no way to ticket the driver with a camera, there is no way for them to know with certainty what CVOR # you were operating under as CVOR, ownership of vehicles and licence plates are not linked.
