Re: Parking in a Fire Route

Hi Tom1331

-I believe that the 75 day deadline only means that they have to file your ticket with the court within 75 days, your actual trial date can be as far away from the infraction date as 12 months. Since you received a court date in the mail it is likely that the City filed its paper work with the court on time. If they hadn't most likely ...

Re: Failed to Stop at a Red Light on a Bike

How badly was the last name butchered? I ask because the courts generally won't throw out a ticket over a minor spelling mistake.

Re: Received suspension because notice sent to old address.

The reason most of the mail for your ticket went to your old address is that tickets are processed through the Provincial Offences Court in the municipality where you got the ticket, not through the Ministry of Transportation. So changing the address on your licence with the Ministry of Transportation doesn't do anything to tell the Court that is ...

Re: Calibration discrepancy or sloppy writing - viable defen

I would have to with Squishy and say that the number we are talking about is a 5, if you look closely you will see that what looks like the back part of a 6 is actually the letter "r" from the end of the word radar on the form. I think all that has happened here is that the officer wrote the number 50 a little too close to the edge of the space and ...

Re: Can anyone confirm what this no parking sign means?

I'm quite familiar with this area and what you are seeing here are signs for what is called "alternate side of the street parking". Most of the houses in this neighborhood don't have driveways and it was decided at some point that it was not fair for the houses on one side of the street to always have to put up with large numbers of cars being ...

Re: Handicapped Parking Ticket, $450, Help?

Just a quick update to let you know that I found a thread in the court procedures section of this site on how to get photos admitted as evidence, definitely worth a read if you are going to use photos as part of your defense. (Tip of the hat to Radar Identified as the author of the post)

Re: Handicapped Parking Ticket, $450, Help?

No problem, always happy to throw in my 2 cents.
For court your girlfriend is going to have to establish that the signage for that spot was improper so if she hasn't already I would go and take some pictures to show that there was no vertical sign there.
When your girlfriend gets her court date in the mail she should file for disclosure and get ...

Re: Handicapped Parking Ticket, $450, Help?

If the parking space did not have a vertical sign then you may have a case as it looks like Reg. 581 of the High Way Traffic Act requires that there be a posted sign not just markings on the pavement. Here is a link to the regulation: http://www.e-laws.gov.on.ca/html/regs/e ... 0581_e.htm

I have to agree with everyone else there is no cost effective way to fight this one. When you add up all the time off of work and the running around you would have to do to fight this it is probably not worth it.

Re: 17 years old, 1 month old car, 7 tickets. Any help?

If it were me I would go with either a paralegal or an attorney that specializes in traffic law. Criminal lawyers don't spend much time in traffic court so they won't have a lot experience dealing with this kind of case. You can fill in the form at the bottom of this page if you want to be referred to a traffic ticket specialist through this site ...

Re: courtesy parking ticket

The only way to dispute a Green P lot Courtesy Charge is to call the Toronto Parking Authority at (416) 393-7275 and ask them if they would be willing to cancel the charge if you show them your parking receipt. I don't know whether they will do it or not. However if you don't pay it I don't think there is much they can do to you. It is not a ...

Re: RECEIVED NOTICE OF FINE WITHOUT EVER RECEIVING A TICKET!

Interesting I thought that unauthorized parking on private property was only $30.00 in Toronto. However I haven't looked in a while so it is possible they have increased the fine or added some kind of fee for tickets that go into default. Still before you pay that notice I would call parking tag operations at 416-397-TAGS (8247) and double check ...

Re: RECEIVED NOTICE OF FINE WITHOUT EVER RECEIVING A TICKET!

-Which city sent you the notice of fine and due date? I ask because $46.00 sounds like an odd number to me and makes me wounder whether that notice actually came from the city or whether it was issued by one of the less then reputable private parking companies. If it is a private parking lot operator demanding money and not the city then you can ...

I found a case while researching my own traffic ticket that might be of use to you. The main focus of the case is about a ticket where the section number is missing, however the Judge also talks about what should happen if a section number is wrong on the ticket and he also lists a number of cases that deal specifically with the issue of incorrect ...

Re: Random stops

Since driving requires a licence, it is perfectly legal for a police officer who observes you driving to stop you and demand that you present a valid drivers licence. Just like for example a liquor inspector can demand that an establishment that is selling liquor present a valid liquor licence or a Ministry of Natural Resources officer can demand ...
