Re: Got stopped while suspended but then let go

The officer has up to 6 months from the date of the offence to charge you. If your fines were paid, then you should no longer be under suspension, but you may still be unlicensed unless you also paid a reinstatement fee. If that's the case, the officer could charge you with "Drive Motor Vehicle No Licence". It carries about a $300 fine, but it's ...

Re: 75 in a 60 zone

You can change your plea to guilty at your next trial date. The prosecutor won't raise the ticket back up to the full amount if there is no trial.

Re: careless driving - nothing serious done, and now adjurne

12 months seems to be the standard before an 11b motion is accepted by the Courts. I don't see 10 months cutting it, especially when your trial has already started.

Stanton :"Points cannot be waived. If you're found guilty, you'll get them. Only way to avoid points is to be found not guilty or make a deal to plea to a different offence with no points"

Thanks so much for your advice! But Ok so this is making me more nervous... would I need someone to represent me then to make this deal? What other offence do ...

Re: 154 in an 80 - Reduced to 114

Go with the lawyer's advice. I guarantee if you go to trial the charge will be amended to the full amount. Passing vehicles isn't justification for speeding, and it isn't like you were going just a little over. I think if you go to Court and try to argue you deserve a further reduction you'll get a nasty shock.

Re: failing to stop at a stop sign - on camera?

When they say failed to stop at a stop sign - its not as if I sped right through and wasnt aware there was a stop sign, I wasnt even going fast since I stopped behind the car in front of me. I didnt stop as long as he did though when it was my turn. But I also yielded to any traffic enough to know there was no traffic in that intersection.

There ...

Re: resersing on off ramp

To the best of my knowledge, the the off ramp still considered part of the divided highway it exits from. If the 40 km/hr speed limit signs are yellow with black lettering, they're only a suggested speed, not an actual limit.

You can sometimes arrange to make partial monthly payments towards your fine, and you'll get your licence back as long as you keep paying.

Re: 98km/h in a 50

Here's the highlights from the Nova Scotia Motor Vehicle Act. Well worth a read if you're ever planning on driving in Nova Scotia.

First, here's the speeding section:
106A) A person commits an offence who exceeds the speed limit by
(a) between one and fifteen kilometres per hour, inclusive;
(b) between sixteen and thirty kilometres per hour ...

I would contact the Court office by telephone to find out what arrangements they've made to notify people of Court dates during the strike.

Re: 98km/h in a 50

A quick read of some sites relating to the Nova Scotia motor vehicle's act would indicate your licence can actually be suspended for 7 days for any speeding conviction of 15+ over the limit!

I'm not sure if that applies to out of province licences or not, but I'd strongly suggest you make some inquiries to find out. If your licence was ...

Re: Disobey Sign

The two yellow signs are just advisory ones, meaning there is no real legal obligation to obey them. However between the two yellow signs in your link, there is the black square sign with a white arrow, which does legally mean the lane is right turn only.

Re: 98km/h in a 50

If you received the ticket in Ontario, the total fine should be $353. With an Ontario licence, you'd receive 4 demerit points, which would result in a warning letter for new drivers but no suspension. If you have a Nova Scotia licence, the charge will still show on your licence upon conviction, since all Provinces have a reciprocity agreement. Nova ...

Re: disobey sign staines rd & steeles ave

so how do I go about pleading to a by law offence?

do I seek out the prosecutor before the trial ie. a few weeks before? or do I show up early?
I'd suggest requesting a first attendance meeting with the Crown prior to trial. The Process varies from region to region, but you can contact the Court office for details. You could also try speaking to ...

Re: Odd Failure to Remain

You may be able to plea-bargain to "fail to report collision," which is nowhere near as serious as "fail to remain." However, make the disclosure request and see what evidence they have against you, if you have not already. I'd also suggest "Fail to Report Damage to property on Highway", section 201 of the HTA as a possibility.

Every person who ...
