You will need to get the witness statements to get an idea of what the other driver said and what the witness said. Only then can you really decide how to proceed.

Did you take pictures? Usually insurance company does not care who got charged and has its own determination rules. If you can show that the truck veered into your lane and you did not veer into trucks lane, then you have a chance of beating it.

No grace periods. Sworn affidavit will not be helpful at all.

They should plead Not Guilty and request a trial with the officer present. Once they get their Notice of Trial, then they can request disclosure (copy of officers notes). Once they get the notes, post the here so we can review.

My opinion is that you should just ignore it. If you choose a trial date, then it may be months and months before that trial date occurs. If you ignore it, it will be dealt with within a few weeks. 50+ over speeding/stunt driving is a SERIOUS offence for insurance purposes and will cause your insurance rates to skyrocket the same as a DUI. Also the officer could have impounded your car for 7 days and suspended your license on the spot if they had wanted to.

FYI officers in Ontario are allowed to speed without their lights on, so the officer will have no problem admitting this in front of the JP and the JP will not care that the officer was speeding because the law says they can. Unfortunately I don't think there is much you can do except complain to the OPP detachment commander and the OPP chief of police by writing letters.

If you just plead not guilty and request a trial and then show up on your trial date, you will get the same kind of offer that you would have gotten at early resoltuion.

I personally have no issue with you putting your daughter on the stand, and I would do the same thing. You can just bring your daughter along on the trial date. You do not need to inform the prosecution prior to the trial date, although you can certainly send them a letter/fax if you want to.

In Ontario it is called the Office of the Independent Police Review Director (OIPRD) and I have made complaints about police offiers in the past and they have basically blown them off.

I do think you have a good case and that you can definitely beat it, but my point was that although the JP may believe you and may not believe the officer, this will not bring any negative impact to the officer and will not end the officers career.

You have pretty much no chance of ending officers career... officer will testify they saw you with no seatbealt and then you will cross examine and then you will testify... JP will make decision based on that and it will not affect officer in any way, even if the JP believes you over officer. Trying to intimidate the prosecutor will not acheive ...

There is pretty much no accountability for Justice of Peace and Judges in this country. If they make a bad decision, then it is up to you to pay out of pocket to take it to a higher court to be found not guity, and there will be no negative consequences for the JP or Judge or Prosecutor or Officer.

There is no rule that prevents your daughter from testifying, so I would bring her along for sure.

No it should not affect your friend, only you.

When you go to court, bring her along so that she can testify. You might get a reduction, and maybe there is a small chance you will get it dropped completely if the JP believes you and her are both sincere.

The police officer must file their copy of the ticket (the Certificate of Offence) with the Clerk at the office within 7 days of the ticket being issued.

For whatever reason, they did not file it so therefore the charge is dropped and you win!

You can call the Provinical Offences office and ask for the status of the ticket if you want to confirm ...

You wait about a month and then you call the Provincial Offences office and ask them the status of the ticket. If you are convicted you will most likely receive a notice in the mail anyways, but call if you are not sure.

Oh right, I did not look back up at the top of the thread!

So the officer is going to testify that they saw you on your phone, and you are going to testify that you were not on your phone but then moved it, so you by your own testimony they would find you guilty.

Did the officer see you move it?

It actually would have been better for you if it was still in the mount because you could have said "look it's in the mount, I was not holding it"

Anyways, get disclosure and see what the officers notes say and then we can better decide if you have a defense or not.

It is a Fatal Error if the section is unknown AND you do not show up for trial. If you show up for trial, then they may be able to amend/fix it.

If it was me, I would NOT respond to the ticket and keep the original in a safe place (scan it as well so you have copy just in case).

You are not allowed to hold the phone at all. If it was mounted and you were using hands free mode while it was mounted and you never took it off the mount and you never held, then you might have a case.
