What about accuracy of speed if adequate testing was not performed at distance of over 500m? There seems to be plenty of case law to support that even where the driver was the sole vehicle on the road.
500m is a very long distance.....and it could be problematic. You will need to impress upon the JP that sweep error is possible at this distance ...

I think what you are getting at is this charge only at issue when 2 vehicles are "travelling" on a road. Read the section your daughter was charged under, you can find it online. Does the incident sound like one of the descriptors listed? Then try looking for the two references in CANLII. Google it, comes right up.

The info you have is for slightly older models and it used to be the norm, i.e +/- 1 MPH, or 2 KMH.... There are some models of moving radar that are capable of measuring speed as well as estimating distance to target. If this happened close to your home I would suggest you select option #3, which is the trial option. After you get your court date you can then request disclosure and or first attendance. The attitude of the officer has nothing to do with your ticket. You will have to plead it either at Frist Attendance or trial. Either way you should be able to beat it, if it does not get tossed first. Just explain the situation the same as you did here. A written record, your words, wouldn't hurt.
