So the way I translate this: Hard acceleration + Police Presence = Time to Chat :D . The funny thing is, no law was broken. Almost the same as the new drinking and driving law, you didn't do anything wrong but you lose your licence anyway. I'm all for the safety aspect of these situations but sometimes it can seem overboard.

I have yet to see anywhere in the HTA where the rate of acceleration is limited :wink: . I would like to hear the 'Bear's take on this.

So we know why he got the ticket, :( , now he just needs to explain the situation in court. He could probably do it himself, if he feels comfortable with it.

The violation was for qoing through an amber (yellow) light. The ticket says:
Driver of a vehicle has a yellow light did not stop before the stop line. (this is translated, the ticket was written in french)

One of my law teachers told us one of the "fatal flaws" is the fine amount. If it is not the same as perscribed in the law, the ticket will not stand. He mentioned it kind of in passing as most of the class was not into hearing the long winded reasoning. Maybe, a poor choice of wording on my part.
I beat a ticket due to this. :D

15over the speed limit = $37.50, with a total fine of $52.50

I would give the local court a call and ask....I do not know the answer how it would be entered as a conviction.

The other option is to ask for a trial and speak to the prosecutor before hand, the prosecutor can then ask the JP to have the ticket withdrawn OR amended the fine to the ...

Also remember, that it is not the speed you can handle it is the speed everyone around you expects you to be going.

I think we could have variable speed limits like down in the states.

If the 401 is next to empty, 130 is good for example.
But trying to address all situations with laws is tricky and so here we will sit at 100. Although most of the ...

My view as a cash grab is that Mr. Fantino remarked after the law came into effect that he should have gone after 30 over.....! :shock: That's the comment that makes me believe it's about the money. Not necessarily speed was the cause in any pileups.

Easy one here to figure out......Driver's failing to adjust their driving habits for the weather conditions.

Driving Habits - slowing down, following distance, driving the vehicle beyond your capability, driving faster than one can clearly see a safe distance to stop

I have paid most of my tickets because I know I was in the wrong. Although, I do know that even the police can be wrong, on occasion not all the time, and you can't make that arguement roadside. So if the officer is polite and not condisending I'll probably pay the ticket. However, if the officer wants to use heavy-handed tactics, bark orders or ...

I believe the cash grab is the 50 over. All of the other listed elements of the racing law fit. Granted you do have to be hard on the loud pedal to be doing 50 over, but we already had a law for that. Why didn't we just increase the fines for the original 50 over instead of including it here?
