The stopping distance and whether you were able to stop is not relevant to the charge.

The only thing the court will be interested in is "were you speeding on that date".

What happened after you were caught speeding is not relevant to a speeding ticket charge.

Speeding Ticket trials are won on the legal technicalities.

Like the above post, the officer has to prove that the offense was committed with a "Motor Vehicle".

Well I wouldnt want this guy representing me, doesn't sound to me like he knew what he was doing.

You dont know why the charge was dropped, probably the officer or witness didn't come to court. I don't think he did anything, certainly he was not qualified to represent anyone at a trial.

Doesn't sound to me that you should be representing anyone. Are you a licensed paralegal? You have to be licensed by the Law Society of Upper Canada to be representing people in court.

Sounds to me like the officer had moving radar with in the police car, especially if its a unmarked car in Toronto which usually does have this type of radar.

The radar works by giving a reading of traffic coming towards the police car or approaching it, and the officer can watch the speed going up or down and then lock it in at the highest speed ...

Just an FYI

The ticket has 2 demerit points on it, if you pay the ticket it will go on your driving record and to your insurance for 3 years. You should make sure that dispute the ticket in traffic court.

My opinion is that the officer has laid the wrong ticket and that if you hire a paralegal that knows about accident investigation that you should be able to have the charge dropped completely.
