Re: Speeding and Follow Too Closely
I think argyll hit the nail on the head. Remember why you are going to court this argument has no bearing on your charge. Police are exempt from various parts of the HTA s128 is one of them . Focus on your cross examination questions not the fact the officer was speeding, was he in the performance of his duties. I would almost bet he will say yes ...

Re: Failure to provide insurance but it was in the car
The operator shall surrender it for inspection upon demand. The operator shall not search their car for it upon demand because they cannot find it. Which could put the operator in danger let's say it was on a 400 series highway in the shoulder the officer may not have wanted a fatality collision on his hands .

Re: Expired Drivers License, and sticker
All tickets are fightable... but these ones are next to impossible to beat, unless the officer does not show up (which is very very rare).
However it is always worthwhile to plead not guilty, request a trial, and request disclosure and then show up on the trial date because as a worst case, you can probably get the fine reduced on both of them ...

Re: Alberta Photo-Radar Ticket
1. The device used is either a photo laser or photo radar unit and does photograph automatically. If radar all the operator does is approve the violation . If laser than the operator actually operates the device which takes a photo as the trigger is pulled automatically.

Re: Red Light - Fail To Stop on Bicycle/Other
So you admittedly didnt stop and got a ticket. The reason you feel like the officer gave you an ''all in'' ticket is because $325.00 is the fine for ''Red light - fail to stop s. 144(18) HTA''. This isn't a speeding fine where the officer can choose to lower the fine.

I don't have much experience with a VIP cable I'm guessing this is specific to Genisis II Select . However Stalker uses a VSS cable which I am assuming is the same as a VIP which does the following : (directly from Stalker)

Re: Early Resolution? Do they even care?
I would choose the NOT GUILTY option and request a trial with the officer present. Once you get your notice of trial, you can request disclosure (officers notes). Once you get the notes, blank out personal/officer info and post here so we can review.
You can always plead guilty and pay at anytime up to the trial without penalty. But you should ...

Re: Can police see insurance by running plates?
Yes, police can check the insurance ''status'' of your vehicle by running your plate on MTO. If you don't have insurance it will show up on the computer as ''UNCONFIRMED'' in big red letters. The system is usually correct, I've personally never seen it wrong as long as its been out.

Re: Early Resolution? Do they even care?
So the other day I got caught looking at the GPS on my phone at a red light and I got the hefty $490 fine that is now given for "distracted driving". The fine is whatever, I can pay that, but because I only have my G2 license I supposedly get my license suspended for 30 days. This is the problem, I work full time and driving is imperative to my ...

Re: STUNT DRIVING CHARGE - NEED ADVICE
The OP would have received a Part 3 Summons if charged with an offence under 172 at the road side. Your a little bit late getting started here, the first thing I would do is get a disclosure request in but do it ASAP .

Re: police not in the court!
No, once the trial starts any deals offered are gone. You only get the deal if you agree to plead guilty to it before the trial starts.
So you probably took the best choice, given that the officer most likely would have shown up if prosecutor called them.
Yes, the days of officers not showing up for Provincial Offences Court are long gone. Most ...

Re: Can an unlicensed/uninsured car be towed by another car?
I disagree...the towed car is not a trailer...As per the definition of "trailer" in the Highway Traffic Act:
"trailer means a vehicle that is at any time drawn upon a highway by a motor vehicle, except an implement of husbandry, a mobile home another motor vehicle or any device or apparatous not designed to transport persons or property..." You ...
