Re: Wasn't wearing seatbelt, was delivering a pizza...

It's obvious to me, that the real reason there was no replies to "infallible" is because folks are worried about giving up trade secrets or getting in trouble at work or some such thing. And that's fine. Helping by critiquing defenses, but not helping as much as they could. Again.....not that there's anything wrong with that. It's better than a ...

So, if you break the law you risk a ticket? Not sure I'm seeing how this penalizes safe drivers.

Re: Never talk to the police & Know your rights

You don't see a problem in this country when exercising your legal rights becomes "foolish and complicates matters"?
You don't see a problem in this country when the police are allowed to lie/deceive you when questioning you, but if you lie to them you can be charged?

Re: Never talk to the police & Know your rights

I don't think a criminal charge and a minor traffic matter are analagous.

I find the whole "I don't have to talk to you" attitude of some people as akin to teenage angst and thumbing their nose at authority. The danger in advising people to exercise their rights in this manner is that if they do not understand what they are REQUIRED to do they ...

Re: Levels of suspicion (reasonable grounds, etc.)

Not sure precisely what you mean about different levels of suspicion.

Reasonable grounds ("A set of facts or circumstances which would satisfy an ordinary cautious and prudent person that there is reason to believe and which goes beyond mere suspicion") is the basis for most charges, but a "reasonable suspicion" articulated by an Officer could ...

Re: insurance - opcf 43 form

It was my understanding that endorsement 43 was only available in the case of new cars when they are purchased, as stated under "conditions" of the OPCF43 form;

3. Limitations on Your Coverage
The following conditions apply:
You must be the original purchaser and the automobile must be new at the time of delivery; and
The loss or damage must ...

Re: Possible Fail to Remain violation

Speak to a lawyer. Right away.

From my own perspective I would counsel MY daughter to report the accident immediately and to take responsibility for her mistake. Reporting the accident BEFORE someone knocks on the door undermines the key element of the criminal fail to remain charge (attempting to avoid civil or criminal responsibility).

She can ...

Re: Possible Fail to Remain violation

Not to get "preachy" but I'm assuming that your daughter was at fault in this collision, hence the lack of concern with the damage that was done to your vehicle.

I'd exercise caution here and speak with a lawyer immediately. Your vehicle was involved in a collision, your daughter may have committed a criminal offence and your simply refusing to ...

Re: Fault determination rules application

Your description of the accident itself is unclear, and makes it hard to offer an opinion on the circumstances themselves.

Adjusters can (and do) consider whether or not the damage to vehicles involved in an accident are consistent with the participants description, but this is not the same as any sort of forensic analysis. It might tip the ...

Re: Requirement to Open Window?

Knowing your rights is excellent - it's personally been my experience that those who yell "I know my rights" the loudest usually do not.

Why would you NOT open your window? The officer is looking for impaired drivers, the sooner you answer his basic questions you're on your way, this dogmatic defence of some perceived protection from ANY invasion ...

Re: Is this legal?

Impaired? Had you been.

An officer may stop any vehicle at any time to check for sobriety, licencing, insurance or the mechanical condition of the vehicle. If you are driving erratically (by varrying your speed as you say) he'd be foolish not to stop you and make sure everything was ok.

By your own admission however what you were doing was ...
