OP, any departure from the posted speed limit is considered speeding, regardless of the situation, as the motor vehicle driver you have the care and control of the vehicle at all times.

Passing is not a defense.

Guys, a plea bargain is just what the name implies. If the prosecutor is offering you a plea bargain and amending the charge, they don't need to prove it as you've said "your guilty" and no evidence is required to be entered. You also give up your rights to an appeal etc.

The process for parking tickets is different now in the City of Toronto, the new procedure is set out by a new bylaw. At the end of the day, even if you are unhappy with the decisions of the review panel, hearing panel, you can still get your day in court in front of a Justice of the Peace, you just need to jump through those hoops first.
