You need to ask for disclosure right away. You can't really begin to plan a defence until you get it.

I assume you entered a plea of not guilty and requested a trial. If you haven't, then you've already been convicted beacuse you only have 15 days to act on the ticket.
You need to request disclosure as soon as you receive the notice of trila and see what evidence the officer has to suppirt the charge that was laid.

It might be a good time to brush up on some of the rules of the road. Either buy an Ontario Drivers handbook or just read the HTA.

You generally can't request disclosure until you receive your notice of trial.

Not true. Under the Provincial Offences Act, a person can spend up to 6 month in jail for those offences.

Maybe you should go into some detail about the incident/testimony and how you got pulled over and charged with the offence. Then we can probably tell you how the officer identified your vehicle.

There must be more to this for a Doctor to receive a patient who fainted" and then suspend your drivers licence for alcohol dependence.
You have a right to have a copy of the Doctors Medical Condition Report that would have been submitted to the MTO by the Doctor.

See the following bulletin from the Financial Services Commission of Ontario.

And the suspension will stay on your driving absract whether someone is convicted or not.

Start by doing a search and reading through older posts. You can't really do much until you request a trial and see what the disclosure is.

Check your payment options listed on the ticket. It can vary from City to City. Some even have an online payment option.

You'll have a very difficult time in court using gps based speeds. You'll have to see what disclosure says if you decide to plea not guilty.

Date of offence and date of conviction are on the abstracts that I look at in court. Can't say about the ones that the insurance company may get. As for demerit points though (insurance companies really don't care about them) they come off after 2 years from the date of offence.

He won't have to show video evidence of the fail to stop unless of course if it exists. You'll have to wait for a court date and disclosure or speak to the prosecutor and come to some agreement.

Just so you're aware. If your Ontario licence is suspended as a result of the unpaid fine, your insurance company will take it more seriously than just the speeding on its own. And you'll still have to pay the fine to get your Ontario licence back as well as a $150 reinstatement fee. Is it worth the risk?
