Re: NEW Durham Police Electronically Printed Tickets Fatal Error
All topics described on the site match very well against the text written in a book I have called "The Law of Traffic Offences", by Scott C. Hutchison. This book is not a "How to beat your Ticket" type of deal. It's a legal manual illustrating important portions of the HTA and POA and how both prosecutors and defendants have been successful in both ...

Re: NEW Durham Police Electronically Printed Tickets Fatal Error
It should be a fatal error. When you get a ticket there are two parts. First you broke some law (e.g. speeding is against the Highway Traffic Act). Second, the process of charging you (i.e. the officer handing you a ticket) is covered under the Provincial Offences Act (POA).
A signature is required under section 3(2) of the POA.

Re: NEW Durham Police Electronically Printed Tickets Fatal Error
Does anyone have any case related information that could be quoted before the plea of not guilty...
How about the Provincial Offences Act itself ;)
PART I
COMMENCEMENT OF PROCEEDINGS BY CERTIFICATE OF OFFENCE
Certificate of offence and offence notice

Re: Advice, please!
...so this statement of Municipal vs Provincial is false!
My opinion is based on my own observations. I've had the pleasure of meeting about 20 different officers on the side of the road, over 30 years of driving. I have always been treated civilly by our local PD. But I have personally witnessed a total lack of self control from 3 separate OPP ...

Re: Advice, please!
Way to go, OPP! Make sure tourists (that spend a great deal of money in our Province) go back and spread the word about how risky it is to vacation in our "land of unique traffic laws".
I live in a city that depends heavily on tourist dollars (Stratford, Ont.) and it is well known by the locals that our police department "looks the other way" when ...

Re: Correction for posting, is this law 6 years old
SWS receivers ARE available without police radar detecting ability. They aren't nearly as popular though, for some reason :?
Most police services are switching to Laser anyway. Might be a good time to look into other (legal) uses for radar detectors. I don't see American cops complaining too much about RD's being legal. They just use Instant-On ...

Solution:
1) Make Radar Detector use LEGAL and mandatory on major highways.
2) Point your radar gun backwards when stopped.
Problem Solved

As with most "apparently" good safety initiatives, this one also comes with a potential risk.
First of all, this section describes "slowing down", but a driver may have slowed down to a speed he felt was safe. It's now up to the officer to file the charge based on his own judgment of what was safe. It's these "subjective" calls made by the officer ...

I'm sure the oil companies have a somewhat more accurate estimate of presently known oil reserves, but they sure aren't going to share that data with us.
The key word is "known" oil reserves. It's commonly believed that there is far more undiscovered oil reserves than the average citizen could know.

This is gonna' irk a few readers here,... but, ya' know, I think the drive-thru line at the local Tim Horton's is one of the most dangerous systems out there. Just try watching people trying to drive down the road immediately after leaving the exit. They're trying to pocket their change, get a quick sip of their coffee, and juggle whatever pastry ...

Re: Turning Right on a Red light 144.18
I'm turning right on a Red unless there's a sign specifically stating not to. It's what people behind me would expect me to do, and being predictable is usually the safe thing to do and decreases the chance of road rage.
Note: We have ONE intersection in town that says "No right on red" and is meant to deter drivers from using a certain side ...
