I am struggling to find any information on what the laws are regarding traffic signs, specifically signs with posted speed limits. Any links would be extremely helpful ! Now to my story: At the time of when my ticket was issued, the road recently finished construction for a roundabout and the signage for the first little while was a total mess. I posted a diagram in hopes of better illustrating the metrics. The road is generally an 80km/h zone(red line). Approaching the roundabout heading south, there is a sign with a posted 60km/h(blue line). After the roundabout, there were zero traffic signs to show what speed the zone was(green line). This stretch of the green line was previously an 80km zone before roundabout construction. After construction and at the time of my ticket, this stretch of green line had absolutely no traffic signs depicting speed limit. However after a week or two of my ticket being issued, there was a sign put up that was not there previously indicating the zone is 60km. I understand that speeding is an absolute liability offense and I was speeding without a doubt. My ticket said "Speeding in a posted 60km/h zone". But the facts are that the zone was not a posted 60km as no traffic signs were present at the time of my ticket; they were put up AFTER my ticket. The traffic signs going north were not congruent with the traffic signs going south in this area. Essentially, I am looking for information or any knowledge on the laws regarding traffic signs and where they must be posted.

The Highway Traffic Act has a regulation that spells out the requirements for signs. It can be found here: https://www.canlii.org/en/on/laws/regu/ ... g-615.html Probably the most relevant part to your situation would be section 2 which states the following:
Probably the most relevant part to your situation would be section 2 which states the following:
2. (1) Subject to section 4, where a maximum rate of speed other than that prescribed by subsection 128 (1) of the Act is prescribed for a highway in a local municipality or built-up area, speed limit signs shall be erected on the highway, in each direction of travel,
(a) not more than 600 metres apart where the speed limit prescribed is 60 kilometres per hour or less; and
If you read section 128 of the Highway Traffic Act, you'll see that the statutory limit for that area would be 80 km/h. Signs dont need to be posted at all unless the speed conflicts with that limit. First of all, what type of sign was the 60 km/h sign? White or just an advisory sign? If it was an official maximum speed sign, then that speed is the limit and because it's a maximum rate other than prescribed rate, only then would the 600m posting be required. You may have to look at the officers evidence to determine if you were within that 600 m

thank you for the help so far ! the sign was white and appeared before the roundabout I measured the distance using google maps and from the roundabout to where the cop would have saw me is 916m if you refer to my diagram, I was dinged going 93 in a 60 at the location of the yellow star. I was under the impression that after the roundabout it went back to an 80 zone edit: other useful information added

They probably got your speed well before you passed them so you're going to want to request disclosure and see where and how exactly they measured your speed.

I was randomly pulled over a few weeks ago on a Saturday night. I was driving friends home after a night out, I did have a few drinks, but I stopped knowing that I will be driving. I guess the time wasn't enough because the breathalyzer gave an "Alert". Anyway I was given a 3 day suspension. I was not charged/or convicted. He simply said that after 3 days I have to go to the…
False tickets issued when legally turning right on red at bronson and carling.
The Carling and Bronson red light camera at this intersection is falsely issuing tickets to vehicles turning right on red based on the assumption that, while approaching the intersection, if you are traveling 25km/hr you will not stop at the light and there for run a red light. I did make a complete stop at the white…
From disclosure, the officers notes state the serial number of the radar unit and that it was a Genesis II Directional.
Also in disclosure were two pages of the radar manual (Field Tests section) and across the top of these pages it says Genesis II Directional (Rev 02/05). So the test pages match the model given in officers notes.
I received the disclsoure 1 day before first trial, so asked for…
Hi, I just received a notice in the mail with pictures of my car going through a red light. Ticket is in my husband's name, as he is the car owner, but I drive this car. I'm guilty as can be... can't remember doing it, but apparently went right through intersection after light turned red. I realize there are no demerit points with this ticket, but ticket is for $180!!!
After searching all over the internet I came accross the TRAFFIC COMBAT site and taking inspiration from that site I decided to fight the ticket. Here are my details
1)I got a ticket under HTA 136(1)(a) -Fail to stop-Disobey Stop Sign on April 17, 2010 in Scarborough.
2) I submitted to challenge the ticket on April 28,2010.
I searched but could not retrieve a satisfactory answer.
It seems matter-of-fact that all sorts of work equipment, namely backhoes, loaders and other similar mororized vehicles without licence plates, sometimes equipped with a slow moving vehicle sign, often not, some with an amber beacon, some without, are encountered on a highway, travelling under their own power, sometimes on multi-lane roads…
Around 8:30PM a few days ago, I stopped at intersection on left lane, waiting for green light, there was another car in front of me, the light turned green, on the right lane, two cars already passed, I released my brake thought the other car would move but it didn't, I ended up rear-ended the other car in front of me, since the speed is very slow, my car has no damage, the…
I recently got a letter in the mail stating that my driver's licence was suspended for not paying a traffic fine. The fine was for speeding at just 5 km/hr over the limit. It was a very very small fine with no points but I didn't pay the fine by the due date. Shortly after I get a letter in the mail saying my licence has been suspended and I have to pay all outstanding fines plus a $150…
I was pulled over for speeding, but my record is clean so I didn't get a ticket. However, I did get a ticket for having the my old address on my plates. The officer told me to go to court for it, and he would drop the charges. What do I say when I am in court if he doesn't remember saying that or doesn't appear?
Hi. I recently got a ticket for the above offence. I was driving a commercial rig, used for soil investigations. I was stopped on the shoulder of Mayfield Rd in Caledon, waiting for traffic control to be put in place (flagmen, signs, etc) so that I could commence my work. I was stopped beside no stopping signs, but wouldn't my waiting for the traffic safety measures to be put up outweigh the…
Good morning drivers, law enforcement, and traffic enthusiasts,
I recently received a ticket for "FAIL TO YIELD TO PEDESTRIAN." I was stopped at a red light in the left lane, signalling to turn left. The light turned green and as I pulled into the intersection, a pedestrian on the left crosswalk began crossing in the opposite direction. As I approached the crosswalk to complete the left turn, the…
I can't find the category for this post so I'm posting it here.
Two questions...
1. Are golf carts considered a 'vehicle' under the Highway traffic act? I know carts can't drive across roads or on roads but if you try to bring one from the USA into Canada they are considered a 'vehicle'.
2. If you are on private property are you allowed to carry 'opened' alcohol in your golf cart? I know golf…
(14) Every person who contravenes this section or any by-law or regulation made under this section is guilty of an offence and on conviction is liable, where the rate of speed at which the motor vehicle was driven,
(a) is less than 20 kilometres per hour over the speed limit, to a fine of $3 for each kilometre per hour that the motor vehicle was driven over the speed limit;
So Again, I really don't know how I'm attracting attention to myself, but I am.
Saturday at 1:30 in the morning I was pulled over on the 400 for 142 in a posted 100 Zone. Honestly, I know I was speeding, but I thought maybe 110-120 (I'm trying to clean up my act.) Anyways, Pulled over, Ticketed, Explained 3 options on the back, and we departed on our way.
I received a speeding ticket for 15 over in York Region. The officer issued me a ticket for someone else[wrong DL info on ticket] but for correct charge and amount. The ticket was not hand written but computer generated. I am concerned how to proceed with this as well as if the officer issued my ticket to someone else and they do nothing with it and I am convicted in my absence of going to…
4 days ago, during the last GTA snow storm, I was merging to highway. The traffic was light and there was a truck moving in the right lane. I increased the speed but the truck accelerated as well and did not let me to enter the lane.
I had to slow down but my car skidded on ice and I hit the truck side by side. I was found at fault. Can I fight the ticket (unsafe lane change)?
I recently received a ticket for failure to use low beams - while following - Ticket was issued Sec 168 (
- it was on the 401 and no one was within 500 meters of me, I was warning a oncoming vehicle that there was an officer hiding (which is not illegal or I could not find a law against it) it was a police vehicle travelling at very high rate of speed in the opposite direction with no lights on…
I've just received my disclosure today. My trial is next thursday. I've already submitted a notice of constitutional question, etc, but I'm expecting this to go to trial as I have received full disclosure. For the sake of this thread let's assume it's going to trial.
By the looks of it, I don't see anything that I can use to my advantage during the trial. What is my strategy for getting…
So I was driving a friend on crutches to Buxton, ON this past Thursday from Brampton. We we're cruising while catching up. So about 10 km before our exit an OPP and unmarked car come tearing down the off ramp. I glance down on the speedometer although I know I wasn't speeding so we continued chatting. There was a pick up truck behind me and a transport truck in the right lane. So my friend…
I got a notice in the mail of a Red Light Camera System offense. I've been trying to do some research on this, but I don't know how out-of-date my knowledge is, and between responses of "fighting these is impossible" along with the common "people need to stop breaking the law and just pay their fines OMG CRIMINALS," I'm at a little bit of a loss. Please see the ticket (images…
I would appreciate ANY help I can get for my daughter. She was just involved in a 1 car crash. It was this past Thursday on Richmond St. by Western Road. Roads were VERY bad. It was 6:20am and she was driving to work. We live out in Lucan and when she got into London (as usual) the roads were horrible. She pretty much slowed down to…
