Re: First Red Light ticket
I've seen a JP give a everyone who filed for a trial and then agree to a $200 beforehand with the prosecutor then plead guilty the JP dropped their fine to $100 no questions asked.

Re: I feel like I am getting screwed here.. advice appreciat
In short the answer is: Yes you are being screwed? By whom? The answer is by you. Your unwillingness/inability spend on an experienced professional to defend you against what is a very serious charge. It doesn't matter if the charge is trumped up having inept representation against a seasoned prosecutor is a serious mistake. If you plan to fight ...

Re: Just came back from court by myself....did I dodge a bul
If you are going to court to agree with the officers version of events then it is best that you plead guilty. Disclosure means you are entitled to study the officers notes about the events that transpired in relation to the charges against you before the trial takes place. The officer reads them before the trial and then paraphrases their contents ...

Same like anyone else. It will depend on the evidence against you, how long it takes for your case comes to trial, if the officer is present, etc.

Re: Just came back from court by myself....did I dodge a bul
Daddy will not be too happy. I'm sure like most parents today he will find a way to blame the officer for doing his job; same like when they blamed the teacher for giving you a D in English so don't sweat it. It's too late now since you cannot take back a guilty plea. You might have been able to get the charge withdrawn if you had investigated all ...

Re: 36 over in construction zone
Fight it like any other speeding ticket. If the evidence against you is strong enough to support a conviction, there are no loopholes you can use to your benefit then you make a deal at that point. Search the thread and see if what others in your situation have done. Keep in mind that you could be convicted of speeding if you admit to going 1kph ...

Re: Rear-end collission, skidding downhill - Careless Drivin
It was an at fault accident, I'm guessing you made a claim for damages so they know what happened.
Careless is tricky, if you plan to go all the way you really need to do your homework and cite the applicable case law. Your biggest obstacle will be that when an accident involves poor weather it can always be argued that you were going too fast.

Re: 145kmph in 100kmph zone, is this consider a "fatal" erro
If you don't have disclosure and receive it at trial the delay will be counted against you eliminating the possibility an 11b charter challenge. Without disclosure any defense is like playing cards without asking to see the other players hand. The rules say that upon reasonable request you are entitled to see the evidence against you before you go ...

Re: 145kmph in 100kmph zone, is this consider a "fatal" erro
At this point until you receive a trial date and request disclosure you will not have a great idea of what the officer will say when they testify. Even if you disagree with the location on the ticket what would be your plan? My magic 8 ball tells me no if you plan on saying "Your worship I was in fact speeding but the officer was incorrect about ...

Testing is important or they wouldn't do it.....I would ask if he tested the unit at the end of his shift and if he says yes ask why it was not in the notes you received. If it is in the notes elsewhere but not provided to you ask for an dismissal or adjournment based on improper disclosure to the fault of the prosecution. At the next hearing you ...

Re: Summons to appear in court for Careless Driving
Go ahead and file the 11b. If you asked for more time and another meeting it could be seen as a neutral delay. (it is really up to the JP to decide) 12 months should be sufficient but it's not a slam dunk. Given how serious a careless charge is I would hire someone reputable to file the 11b whom can make the proper arguments on your behalf. It ...
