Re: 3 tickets at once !
I was charged with failed to submit insurance once. My insurance was just renewed and I have forgotten to take the new card into the car with me. The police officer advised me to just show up in court and bring my original copy of insurance card, that shows that I have insurance coverage on the date of offence. I did so and it was review by the ...

Re: Made an improper right turn, but got a red light ticket
Thank you Stanton. I agree with what you said. If the dash cam footage clearly shows my offence (that I remembered wrong and the light was amber), then I would have no defence and would be better of just take any plea deal if offered.
I think it is more likely that the crown does not produce the video evidence, since I understand getting proper ...

Made an improper right turn, but got a red light ticket
Hi all, I have a question regarding a ticket I got yesterday afternoon. I intend to take this to court, so I'm asking about what sort of defense strategy(s) I should employ, and I appreciate any help that I can get. I will include as much detail as possible, so imminent walls of text. TL:DR version is at the end. I apologize if I am asking ...

Re: Somebody clipped my car; unsure what to do
So there were no witness and no collision report? I think you'll be fine.
Worst comes to worst he would bring it to court, you can argue there were no visible damage to his car and he was speeding. You can also mention he refused cleaning dirt of his door to access damage.
Don't think he can manage to get you to pay. Good thing there's not much ...

How to find old case laws
Hello all,
I am preparing my defence against a 15 over speeding charge. I'm in the process of looking for some case laws to support my defence, specifically whether the police officer followed proper procedure to test the laser unit. I read a lot of reference to R v Niewiadomski [2004] OJ No 478 and wanted to dig that up, yet I am not able to find ...

Re: Requesting disclosure in toronto
will be against the radar unit, as it has no way of telling which target(car) it got the speed from and there were A LOT of cars near me and at the opposite direction. The bridge also have lots of metal parts.
- Majority of radar units have directional capabilities in stationary mode, thus eliminates opposite direction traffic all together ...

Re: Requesting disclosure in toronto
Another question :p Thanks for all the kindly answers btw~
The FYST(magma) site advices that we change our court date when we are first assigned one to decrease the chance of the cops showing up. But doesn't that void our rights for a speedy trial? The site suggests that unless I've delayed it multiple times it's okay, but I find it hard to argue ...

Re: Requesting disclosure in toronto
The reason I'm insisting on fighting this is that:
1) I currently have a clean driving record and if I get convicted my insurance will spike as I'm under 25
2) I honestly did not know what speed i was driving as I kept my eyes on the road not the speedometer. However it was 9am in the morning and i was in the middle of traffic with cars in front ...

Re: Requesting disclosure in toronto
I was pulled over on Bloor St. West near the entrance to Don Valley Parkway, which i believe is an unposted 50. Do the Crown need a by-law for that as well?
Also, I was under the impression that we should apply for a stay with non-disclosure, so instead we should ask for adjournment?
One last question, the officers told me that I was driving 69km ...

Re: What are your Driving Pet Peeves?
I cannot stand people who make a stop on the right lane (especially/mostly in downtown Toronto, where there are a lot of busy 2-lane streets), and get off the car to go somewhere, or just park there and wait to pick someone up or something, and in turn congest the whole street, as if it's his own driveway.
There must be some sort of regulations in ...

Requesting disclosure in toronto
Hello, I recently got my first speeding ticket and is planning to fight it.
My question is that how do I properly request disclosure? I went to the magma site and it says to send a letter to the court/prosecution office. However while browsing this site I see that there's a form that you have to fill in at the court office while filing you ticket ...
