Re: What do you think about this accident?

My opinion is that the van 100% at fault. Both vehicles had the right of way into their own lanes.

The vehicle with camera made a left turn on a green light into the left lane correctly, but the van turned right and did not stay in the right lane, but crossed over.

Had there only been one lane that they were both turning into then it could be ...

Re: Speeding ticket with fatal error?

It is acceptable for them to put HTA instead of Highway Traffic Act.

My opinion on them leaving it blank means that you were prejudiced as you are not a lawyer and do not know what act to look in. Two things will happen since you are past the 15 day...

(1) JP will look at ticket and see the error and quash and ticket will go away.
OR
(2) JP will ...

Re: dash cam

Then how can you record the actual interaction while pulled over?

Again in my opinion it is just best to not mention it.

Re: A question about disclosure

No it does not matter who the delay is attributed too if there is no chance of getting an 11b... but point was that if it got dragged out a long time to where an 11b might be in the cards then you can not count any time that was attributed to you, so you have to meet the 11b time frame PLUS any time delays caused by you.

With the OPP they ...

Re: A question about disclosure

Not including your phone number won't help as it is YOUR responsibility to check if it is ready and to pick it up.

Have you already sent letter asking for disclosure?

Basically you could just wait until the trial date and show up and say you would like disclosure and to review it with a lawyer before you decide how to plead. This should get you ...

Re: Strange 159(3)

Now there are sometimes rules posted saying you can not record on public property, however you can do so secretly and do not have to admit that you are recording if somebody asks.

Re: Received Notice of Trial - need advice on next step

Again if you can get them to admit that it could have been an iPod Touch, the burden would jump to the prosecution to make the claim that is also a handheld communications device.

Re: Strange 159(3)

It is up to you to check if disclosure is ready and it is not up to the prosecutions office to hunt you down. I always put a mailing address, phone number and an email address on my requests though anyways. But the fact that they lost it is the issue, not the fact that you did not leave them a phone number because you called and they said it was ...

Re: Speeding ticket - court in 10 days

Yes we would love for you to post results of what the outcome was. Not enough people come back to tell us what happened.

The officers notes will say what the original speed was, so then you will know that if you go to trial and lose what the speed will be increased too.

Can you scan the ticket and post (with personal/officer info blacked out)?

Re: dash cam

Personally I would not tell them I was recording anything.

As a side note, some dashcams can display information on the recording like vehicle speed. Unless you routinely drive at or under the speed limit, then you do not want that information on the recording.

Re: Received Notice of Trial - need advice on next step

Questions I would ask the officer...
-How do you I was searching for insurance policy info?
-Could the device have been a touch screen iPod?
-Are you aware that iPods are MP3 players?

If you can get officer to admit that it could have been something like an iPod Touch mp3 player (not a communications device), then there is doubt as to section 78.1 ...

Congratulations on sticking it out to the end. At least the reduced charge is significantly better on your record than a careless one.
