Re: Charge Withdrawn - Success story

This information is very very readily available,
- Industry Canada standard is printed in the radar manual

It may be on some manuals but definitely not on all... I have a Decatur Genesis-VP manual in front of me and while it has a nice FCC certification note in it, but there is nothing referring to Industry Canada certification.

Re: Was the incorrect sign used? 25 over in a 50.

If it is not marked as you indicate, there is 2 speed limits of:
- 50km/hr in a built up area (inside city limits)
- 80km/hr in non-built up area (rural)
Under the law, is it strictly whether the road is in a "town" or "township" that determines the default speed limit? There are a few townships that have become towns even though they have some ...

Re: Incomplete/improper disclosure

As for the temperature range, that's to prevent damage to the instrument (mainly the battery), it should have no effect on accuracy. And if the true outdoor temperature was within range, I don't see what benefit there would be to introducing weather evidence.

Manufacturers state operating temperature ranges on electronic devices like this ...

Re: 11b Application Question.

Hi there,

I'm just wondering - is it absolutely necessary to to include a copy of the ashkov and morin cases? There is a ridiculous amount of pages and in the end will cost me more than the cost of the parking ticket to print all that =\.

I just included the first part up to the "Authors cited" section. Worked out to 5 pages total with the font ...

Re: Fatal Error on Summons?

I don't know what "fatal error rules" you're referring to, but, as I said, anything that prejudices your ability to make full answer and defence is usually considered a fatal error, which makes sense if you think about it. In my experience, fatal errors would be things like no date, wrong or missing act or section number, no defendant listed, no ...

Re: Different speed limits on both sides of the road

Speed limits are to be the same on BOTH sides of the road, in normal<-------- driving conditions. Construction, special events etc. will change things. If you can find a location where the speed sign are offset by a considerable margin, 100's of meters not 10 meters, it is a valid arguement in court that you were not speeding.

That's interesting ...

If you are convicted and the JP gives you a 60 day extension to pay the ticket, do the demerit points get applied that day or 60 days later when you actually pay the fine?

Re: My experience at Queen St court house

During this time the officer that had charged me was talking to his other police friends and trying to get me intimidate me, but since I ignored it, he then decided to approached me and take more direct route.

When I went for a court appearance a few years ago I had an officer like that. Before the trial he kept asking me questions when the ...

Re: 22 km over (72 in 50 zone)

I'd file it now. The delay is apparent now, so you may as well get the paperwork in. That said, as long as you have it filed at least 20 calendar days before the next trial, you'll be okay.

When I filed an 11B, I then received a request from the prosecutor for the transcript of the court proceedings where the adjournment was given. It was stated ...

A paralegal I spoke to used the phrase "The Magic 13" to refer to 13 months but I guess it depends on the case and the JP.

Re: Did you get the same JP for your second trial date?

I find it surprising that no one has responded to this post.
Would any one please let me know whether or not you had the same JP for your initial and adjourned trail dates?
Thank you

I've had two adjournments. On the last one I got the same JP which was good because he was a nice guy. On one about 6 years ago I had a really nasty JP who was very ...
