you should be pretty worried at this point, if prosecutor doesn't offer you a 49 over now, chances are slim to none come court date even with a paralegal
it will go to trial and the JP isn't as lenient. you are probably fooked

Regardless reduced or not you should always put thru the trail option unless you are too rich and don't care about your insurance. The insurance hiking is not a one time thing and it takes you years to go back to the same rating group. And yes a minor is not such a big hike but still takes years to recover. If there are no fatal errors, you won't have it dismissed unless you or someone acting for you is there.

Another question - it says for Option 2 that I can speak with the justice but it has to be done in person on a Tuesday between 9am-10:30am? Do I just call ahead and attempt to speak with the prosecutor anyway? The office is at Wasaga Beach and I won't be able to attend in person

Prosecutor for Midland is in Barrie, so you would have to contact the Barrie Prosecutors office to find out if they can do Option 2 via phone. If you go to trial, that would take place in Penetanguishene.

Yes a missing location is a fatal error. However in order to beat the fatal error you must NOT go to trial because they can fix/amend the error once the trial starts.
What I would do is fax a letter to both the prosecutor and the clerk ASAP. In the letter I would say this:

Did the officer neglect to put a location on this ticket or did you blank it out for privacy reasons? If the location is missing does anyone know if that still constitutes a fatal error? I know ticket combat says that no location is a fatal error, but the info on that site is quite old.

Well the officers notes are pretty clear, so without video the chances of winning are slim to none. Your dads statement did not help either. Will video help? We won't know until we see it! You do have the right to see the video (if it exists) whether or not the prosecution plans to use it or not.

You can always ask... it never hurts to ask!
The prosecutor may or may not agree with your request, but it is ultimately the JP that needs to decide about whether or not they will lower the fine.

Well you have the right to see the disclosure and the case against you. Will you argue that you did not know about asking for disclosure until just recently and that is why you are asking now?

Best of luck to you, this is not an easy fight to win. Onus will be on you to prove you had coverage on that specific vehicle. Driving without insurance is a reverse onus charge.

I believe by pleading guilty to the conviction, it will make you seen as a 'high risk' driver and you will be on facility insurance. From an insurance point of view, I think even after 3 years, they will still put you on facility insurance. The only way to find out for sure is to contact the insurance company. Convictions/offenses stay on the MTO ...
