As Ynotp said you can still force a fatal error by simply not showing up for your court date. The only difference is that the process will take a little longer because you will now have to wait for your court date to pass before the ticket will go into default proceedings.

You will need three copies of both those documents so that you can give one to the judge, one to the prosecutor and keep one for yourself. Also you will want to have the original ticket the cop gave you on hand in case the judge wants to see it.

It might be worth hiring someone with experience fighting tickets in Quebec. The laws in Quebec and their court procedures are based on French Civil Code as opposed to the rest of Canada where laws and court procedures are based on English Common Law. I think the original poster may have slightly misunderstood what the officer was saying. If I had to guess I think what the officer meant was that the warnings would be noted in that force's computer system and that if the OP was pulled over again the next officer would see the warnings and be less likely to cut the OP a break on the new offence. Unfortunately once you've paid the ticket it is next to impossible to go back and fight it. Paying the ticket is the same as voluntarily pleading guilty in court, once you have done it the court considers the case closed.

Pretty much what Ynotp said. To win in court you would have to somehow cast doubt on the officer's observation that you were not wearing a seat-belt. You can always file the ticket for court, request disclosure and see what the officer's notes say. Sometimes you can find an error or inconsistency in the officer's notes that can be used as a defence.

Wait until the JP is done with it. The JP should notice the error on your ticket and quash it, in which case you won't have to do anything. If he misses the error then you can go ahead and appeal using London vs Young.

One question is your ticket electronically printed or is it hand written? I ask because electronically printed tickets don't need to have a physical signature on them, hand written ones however do. So if your ticket is hand written you can ignore it and hope the JP reviewing it notices the missing signature and quashes the ticket. If your ticket is ...

It would be worth booking a trial date and then requesting disclosure. That way you can see what evidence the officer has against you. If the evidence is weak you can go to trial, if it looks strong you can always plea bargain for a lesser fine.

The form form ticket combat should be fine, I don't think they will give you any trouble. Just make sure you provide all the information they need to process your request. How long ago did you get your ticket? If your court date is set more then 12 months after you received the ticket you might be able to make a charter challenge under section 11b for unreasonable delay. That is assuming you didn't do anything to contribute to the delay.

Unfortunately there is no quick way out of this one. The best way to proceed will be to wait for disclosure then see what they have. Since the officer didn't see the offence the lady who witnessed it is going to have to show up in court and testify. Since you were charged under the NCCTPR the rules governing signage under the HTA don't apply. At any rate the default speed under the NCCTPR is 60 kph so even if there was no sign you could still be charged with going over the default speed limit.
