I would avoid doing this in a public parking lot or any place that is open to the public. There is a good chance that the car's insurance would not cover you since you are not a licensed driver. While technically they can send your ticket into default proceedings after 15 days, it usually takes them a little longer than that to get around to it. Obviously the longer you leave your ticket unanswered past the 15 day mark the more likely it is that the city will do the paper work to get a default judgment against you. The regulations for S. 154.1 only list HOV designations on a number of 400 series highways. Toronto By-law 950-503 seems to regulate HOV lanes on city streets in Toronto. I agree with the other posters, it looks like the officer charged the OP under the wrong law. I've posted what seem to me to be the relevant pieces of legislation here.

Was this on a Kings Highway or a city street? If it was on a city street then you will have to refer to that city's HOV lane by-law.

Here is a link to the minimum signage requirements for disabled parking spaces as set out in the Highway Traffic Act. As bend pointed out, you should also look at the by-laws for the city in which the ticket was issued as they may require additional signage or markings over and above the minimum required by the Highway traffic Act.

I don't think you will have been convicted by default yet, although it never hurts to call and check. Typically with a parking ticket if you don't respond within 15 days they will send you a notice of impending conviction in the mail which gives you an additional 15 days to respond before they go to court to get a default judgment against you ...

Unfortunately beating this ticket outright will be hard. The sign you describe sounds like it meets the specifications for signage set out in the Highway Traffic Act, so you won't be able to argue improper signage. The TPA issues courtesy notices to people who have paid for parking but over stayed their time. The charge is the difference between what you already paid and the lots daily maximum. It could be that they have just been slow to process your payment. Some times the court houses are only open a few days a week in some of the small towns in upstate NY, so it is possible that nobody there has checked the mail yet. As others have said, it is technically possible. However, I think the odds of anybody reporting you and the police bothering to follow up on it are pretty small.

I'm not sure where the officer got the number 406 from, possibly he had a brain cramp and was quoting the wrong bylaw number. As others have said, it will depend on how the issuing police force handles ticket writing and note taking. Some have gone over to computerized ticketing and note taking, some haven't. It is also possible that some forces may have computerized note taking but are still issuing hand written tickets.

I would be interested in seeing a full scan as well, because whether this is a fatal error or not will depend on which piece of white paper you are talking about.
