In early 2010 an Ontario Court of Appeal has ruled that stunt driving law is CONSTITUTIONAL. Toronto courts are pretty tough on stunts, i suggest you seek legal representation.there have been recent case law developments that have seen the racing fine dismissed as being unconstitutional

This will never happen. Drive Under Suspention is a lot more serious than speeding. Do not take this case lightly and obtain advise from someone competent before you make your decision.plea guilty to speeding and have driving under suspension dropped.

Absolutely. This delay is certainly outside of the reasonable time frame. Ensure you have transcripts ordered and ready for your charter motion.So it will be 16 months at that point from when I got the ticket. Should I file for a stay based on lengthy delay?

Respectfully disagree........ This mistake does not set out proper offence and the certificate should be quashed rather than amended.
Personally, I would let this ticket go FTR (fail to respond) and file an appeal to get this matter quashed.

Speeding ticket is the least of your problems at this time. If you get convicted for Driving Under Suspension your licence will get suspended for another 6 months plus a hefty fine.

You may be able to argue that the mistake is misleading and may win. This argument has to be addressed at the appeal level as at trial level this error can be amended to reflect proper section number (or offence wording for that matter:)

You should get professional representation for this charge. Taking chances with Careless Driving allegations is just not what people should do. Your discussions with the crown is part of attempt of resolution of this allegation. If the crown whishes to ask the Court for an amendment you should argue against it at Court.

Just to assist you in this: municipal prosecutor DOES NOT have a right to amend the charge. Any amendments are to be done by Court. The prosecution may ask the Court to do it but it is open to your response and arguments to the contrary.
The Court has to consider sections 34, 35 and 36 of the POA before any amendments can be done.

I would respectfully diagree with the chances of beating this allegation. If you were not driving the motor vehicle in question.....there is no case for the prosecution.
