Re: Disclosure requested 3x, want to file a motion

10 days is not a lot. You want to ask for is a continuance, time to look over the evidence, since during your 10 days you also have to work and sleep...etc. You should get it.

Re: Disclosure requested 3x, want to file a motion

When you go to court make sure you have the fax confirmations with you. If you are handed your disclosure immediately before the trial, wait your turn and ask the JP for a stay due to lack of disclosure. It probably won't happen but you will mostly get a continuance to look over the documents. This could be weeks or months, depends on where you are ...

Re: Looking for professional advice - reduced ticket

Should I pay the fine? If so, why? What will be the consequences?
If not, why?
Pay the fine or fight the charge it's up to you. Question is can you prove you were not going 127 in a 90. 15 over isn't that bad....again it's up to you.

Going by your story, you should be able to go back to that intersection and take some pics or video next time it is raining.

Due to the seriousness of the charge though, legal representation would be advisable.

Lidar does have it's faults but you will need to read the manual to find out what they are.

Re: speeding help needed.

Send that in and see what you get. You may have to send it twice, registered mail or fax with transmission record will do. Then you wait. Do you have a court date yet?

Re: speeding help needed.

The device on the tripod was most likely lidar.

In your disclosure you may want to ask for both officer's notes, testing notes including alignment checks, and a copy of the users manual for the speed detection device used.

Research S.159 and look for the definition of "Emergency Vehicle" and the conditions for "moving over".

Re: Trial/disclosure strategy for Speeding ticket

Sorry to disappoint, but it is challenged on a weekly basis in POA courts in Toronto. Unless you have an expert witness who can testify that the tests conducted by police are not sufficient to prove the device was working correctly, you're in a major uphill battle, IMO.
