Re: Collision making left turn on Bathurst

Unfortunately there's not much I can tell you except what you already know. This is one of those things where both drivers could get charged, strictly from a Highway Traffic Act perspective: Him for failing to drive in a marked lane, you for failing to yield. The requirement to yield even applies where someone else is using the median as a passing ...

Re: If a cop claims that your speed was 84 km/hr in 60 zone

"Previous studies have shown that a correlation exists between the degree of terrain slope and the magnitude of errors observed on the slope. The relationship is positively correlated with errors increasing to a theoretical limit of infinity as slopes approach 90"

This has been tested in courts many times before. It works in the driver's favour ...

I don't see why you couldn't, provided that you've got your licence back (should be mailed to you) and you've paid the licence reinstatement fee...

Re: If a cop claims that your speed was 84 km/hr in 60 zone

Could someone please advise me what should be on disclosure request in case of speeding?

I was given a ticket for speeding 70km/hr in 60 zone but, according to the officer, the speed was 84 km/hr. He did not show me the reading though. Also, it looks like he started clocking me BEFORE I was going up (the rode dips and rises to where officer was ...

Re: If a cop claims that your speed was 84 km/hr in 60 zone

Ive never heard that cops can reduce traffic tickets. Are you 100% sure that its legal?

It is perfectly legal. Why wouldn't they be allowed to give you a lower speed and fine? They're doing you (and other drivers) a favour.

Here's a case that talks about a lot of the questions you have:

Durham v. Snowden

The Coles notes version:

- Driver ...

Re: Fire Truck Sitting in Station Driveway Motionless

Seeing as how you said he was stationary for 20 seconds and you hadn't seen any movement, you may have a defence, depending on how sympathetic the JP is. Since you kept driving, the Prosecutor will argue that you should have stopped completely instead, and made sure the truck was not going to move, e.g. make eye contact with the driver of the fire ...

What you're looking for is this link:

O. Reg 577

It is 1 1/2 inches in diameter or less where tarping is required, but there's about a dozen exceptions/limits/etc. Take a look... If you have some sort of proof that it was 4-6 inches diameter, you should (if I'm reading O. Reg 577 correctly) you should be able to get it dismissed.

Re: HTA 172 'Perform Stunt' cause tire to lose traction.

I think this is a pretty easy dismissal once it hits the courts as I feel I have a solid defence, but what my concern is compensation for impound fees and reinstatement fees. Do I have any grounds here once I am found not guilty?

Unfortunately, no. Without getting in to my personal opinion of s. 172, one of the things it does is de-facto impose ...

You don't prove anything. You report it to the police and let them deal with it.

Yes they absolutely would. Failing to remain at the scene of a collision is pretty serious. You should report that to both the police and your insurance company.

Re: Failing to yield from private driveway (collision)

Unfortunately the fact that the other driver may have been unlawfully passing isn't a strong defence if it goes to trial. Section 139 (1) states:

139. (1) Every driver or street car operator entering a highway from a private road or driveway shall yield the right of way to all traffic approaching on the highway so closely that to enter would ...

If you're actually asking that question, you're either trolling or shouldn't be on the road.

when I was stopped, the PC pulled out a voice recorder (and poked it through the passenger window) and said to me that he was going to be recording our conversation
same thing?

Never had that happen. Was that in the UK? Here, many of them wear body cams or mics but not all of them do.

Not really sure the audio recording is relevant without ...
